Entweder steht der Verdacht im Raum, dass der Nachlass \u00fcberschuldet ist und man am Ende f\u00fcr fremde Schulden geradesteht. Oder das Erbe ist durchaus werthaltig, nur ist es im Testament so eingeschn\u00fcrt, dass kaum etwas \u00fcbrig bleibt, wor\u00fcber man selbst bestimmen kann.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-43ef0fe\" data-block-id=\"43ef0fe\"><p class=\"stk-block-text__text\">F\u00fcr den Pflichtteil ist dieser Unterschied entscheidend. Im ersten Fall f\u00fchrt die Ausschlagung dazu, dass am Ende gar nichts ankommt, auch nicht \u00fcber den Pflichtteil. Sie betreffen den belasteten Erbteil (\u00a7 2306 BGB), das ausgeschlagene Verm\u00e4chtnis (\u00a7 2307 BGB) und den \u00fcberlebenden Ehegatten in der Zugewinngemeinschaft (\u00a7 1371 Abs. 3 BGB).<\/li>\n\n\n\n<li>Wer im Testament schlicht \u00fcbergangen wurde, ist gar nicht erst Erbe geworden und muss nichts ausschlagen. Sein Pflichtteil entsteht schon mit dem Erbfall.<\/li>\n\n\n\n<li>Die Ausschlagungsfrist betr\u00e4gt sechs Wochen ab Kenntnis vom Erbfall und von der eigenen Erbenstellung, bei Auslandsbezug sechs Monate (\u00a7 1944 BGB).<\/li>\n\n\n\n<li>Die Erkl\u00e4rung muss zur Niederschrift des Nachlassgerichts oder mit notariell beglaubigter Unterschrift abgegeben werden (\u00a7 1945 BGB).<\/li>\n\n\n\n<li>Geht es um Schulden, hilft der Pflichtteil nicht weiter. Er wird aus dem Nachlass nach Abzug der Schulden des Erblassers berechnet und ist bei einer \u00dcberschuldung wertlos.<\/li>\n\n\n\n<li>Zur\u00fccknehmen l\u00e4sst sich eine wirksame Ausschlagung nicht. M\u00f6glich ist nur die Anfechtung, und auch die nur unter engen Voraussetzungen.<\/li>\n<\/ul>\n\n\n\n<h2 id=\"warum-die-ausschlagung-den-pflichtteil-im-regelfall-kostet\" class=\"wp-block-heading\">Warum die Ausschlagung den Pflichtteil im Regelfall kostet<\/h2>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-83cc795\" data-block-id=\"83cc795\"><p class=\"stk-block-text__text\">Der Pflichtteil steht nicht jedem zu, der leer ausgeht. Er setzt zweierlei voraus. Die Person muss zum engen Kreis der Pflichtteilsberechtigten geh\u00f6ren, und sie muss durch Testament oder Erbvertrag von der Erbfolge ausgeschlossen sein (\u00a7 2303 BGB). Berechtigt sind nur die Kinder des Verstorbenen, an ihrer Stelle bei Wegfall die Enkel, au\u00dferdem der Ehegatte oder eingetragene Lebenspartner sowie die Eltern. Die Eltern kommen allerdings nur zum Zug, wenn keine Abk\u00f6mmlinge da sind, die den Pflichtteil verlangen k\u00f6nnen. Ein Enkel schlie\u00dft sie damit ebenso aus wie ein Kind (\u00a7 2309 BGB). Geschwister, Nichten und Neffen geh\u00f6ren nie dazu.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-1035e59\" data-block-id=\"1035e59\"><p class=\"stk-block-text__text\">Der Pflichtteil ist dabei kein Anteil am Nachlass, sondern ein Anspruch auf Geld gegen die Erben. Seine H\u00f6he betr\u00e4gt die H\u00e4lfte des gesetzlichen Erbteils. Um sie zu bestimmen, wird zuerst gefragt, was der betreffenden Person ohne Testament zugestanden h\u00e4tte. Dieser Anteil wird halbiert und auf den Nachlasswert angewendet, nachdem die Schulden abgezogen sind. Hinterl\u00e4sst ein verwitweter Vater zwei Kinder, l\u00e4ge der gesetzliche Erbteil jedes Kindes bei der H\u00e4lfte, die Pflichtteilsquote betr\u00e4gt also ein Viertel.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-6706b6b\" data-block-id=\"6706b6b\"><p class=\"stk-block-text__text\">Wer ausschl\u00e4gt, wurde nicht ausgeschlossen, sondern hat sich selbst entschieden. Rechtlich gilt er zwar so, als w\u00e4re er nie Erbe geworden, und an seine Stelle r\u00fcckt der N\u00e4chstberufene (\u00a7 1953 BGB). Ein Pflichtteilsanspruch entsteht daraus aber nicht, weil die Voraussetzung des \u00a7 2303 BGB fehlt. Dasselbe gilt f\u00fcr den gesetzlichen Erben, der ohne Testament berufen ist und ablehnt. Auch er geht anschlie\u00dfend leer aus.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-0d97e6f\" data-block-id=\"0d97e6f\"><p class=\"stk-block-text__text\">Daraus folgt ein Punkt, der in der Praxis viel Geld kostet, weil er st\u00e4ndig verwechselt wird. Wer im Testament gar nicht auftaucht, muss nichts tun, um seinen Pflichtteil zu behalten. Er ist bereits enterbt, und zwar auch dann, wenn im Testament kein Wort \u00fcber ihn steht. Der Anspruch entsteht mit dem Erbfall von selbst (\u00a7 2317 Abs. 1 BGB). Eine Ausschlagung w\u00e4re in dieser Lage sinnlos, weil es nichts auszuschlagen gibt.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-3e33e33\" data-block-id=\"3e33e33\"><p class=\"stk-block-text__text\">Dosieren l\u00e4sst sich die Ausschlagung ohnehin nicht. Sie erfasst immer den gesamten Erbteil, eine teilweise Ausschlagung ist unwirksam (\u00a7 1950 BGB). Bedingungen oder Fristen darf sie ebenfalls nicht enthalten (\u00a7 1947 BGB). data-block-id=\"b4d88c0\"><p class=\"stk-block-text__text\">Die erste Ausnahme betrifft den Fall, dass jemand zwar als Erbe eingesetzt wurde, das Testament seine Stellung aber belastet. Welche Belastungen gemeint sind, z\u00e4hlt das Gesetz abschlie\u00dfend auf (\u00a7 2306 BGB):<\/p><\/div>\n\n\n\n<ul class=\"wp-block-list\">\n<li>wenn ein Nacherbe eingesetzt ist, man selbst also nur Vorerbe ist und das Verm\u00f6gen sp\u00e4ter weitergeben muss,<\/li>\n\n\n\n<li>wenn ein Testamentsvollstrecker den Nachlass verwaltet,<\/li>\n\n\n\n<li>wenn eine Teilungsanordnung vorgibt, wer welchen Gegenstand bekommen soll,<\/li>\n\n\n\n<li>wenn man ein Verm\u00e4chtnis erf\u00fcllen muss, also einem Dritten einen bestimmten Gegenstand oder Geldbetrag herauszugeben hat,<\/li>\n\n\n\n<li>wenn eine Auflage zu erf\u00fcllen ist, etwa die Pflege des Grabes oder die Versorgung eines Haustiers,<\/li>\n\n\n\n<li>und wenn man selbst nur als Nacherbe eingesetzt ist (\u00a7 2306 Abs. 2 BGB).<\/li>\n<\/ul>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-4d888e8\" data-block-id=\"4d888e8\"><p class=\"stk-block-text__text\">Liegt einer dieser F\u00e4lle vor, hat der Pflichtteilsberechtigte die Wahl. Er kann den Erbteil mitsamt den Belastungen annehmen. Oder er schl\u00e4gt aus und verlangt stattdessen den vollen Pflichtteil in Geld. Bis Ende 2009 kam es dabei noch auf die Gr\u00f6\u00dfe des Erbteils an. Seit der Erbrechtsreform, die f\u00fcr alle Erbf\u00e4lle ab dem 1. Januar 2010 gilt, spielt die Quote keine Rolle mehr. Die Wahl besteht unabh\u00e4ngig davon, wie viel dem Betroffenen zugedacht war.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-cce0c31\" data-block-id=\"cce0c31\"><p class=\"stk-block-text__text\">Die sechs Wochen beginnen hier erst, wenn zur Kenntnis vom Erbfall und von der eigenen Erbenstellung die Kenntnis von der Belastung hinzukommt. Ma\u00dfgeblich ist der sp\u00e4tere der beiden Zeitpunkte. Wer das Testament erst Wochen sp\u00e4ter zu Gesicht bekommt, verliert seine Wahlm\u00f6glichkeit also nicht automatisch.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-3f33bb4\" data-block-id=\"3f33bb4\"><p class=\"stk-block-text__text\">Ebenso wichtig ist, was nicht z\u00e4hlt. Die Aufz\u00e4hlung im Gesetz ist abschlie\u00dfend. Eine unbequeme Erbengemeinschaft, ein zerstrittenes Verh\u00e4ltnis zu den Miterben oder eine schwer verk\u00e4ufliche Immobilie sind keine Belastungen in diesem Sinne und er\u00f6ffnen die Wahl nicht.<\/p><\/div>\n\n\n\n<h3 id=\"wann-sich-die-ausschlagung-rechnet-und-wann-nicht\" class=\"wp-block-heading\">Wann sich die Ausschlagung rechnet und wann nicht<\/h3>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-c64bdce\" data-block-id=\"c64bdce\"><p class=\"stk-block-text__text\">Ein verwitweter Vater hinterl\u00e4sst zwei Kinder und ein Verm\u00f6gen von 600.000 Euro nach Abzug aller Schulden. Er setzt beide Kinder je zur H\u00e4lfte als Erben ein und ordnet eine Testamentsvollstreckung f\u00fcr zwanzig Jahre an. Die Pflichtteilsquote jedes Kindes betr\u00e4gt damit ein Viertel, also 150.000 Euro. Wer annimmt, ist an 300.000 Euro beteiligt, kann dar\u00fcber aber zwei Jahrzehnte lang nicht bestimmen. Wer ausschl\u00e4gt, bekommt 150.000 Euro als sofort f\u00e4lligen Geldanspruch. Die Ausschlagung halbiert hier den Wert und verschafft daf\u00fcr sofort verf\u00fcgbares Geld.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-5165f64\" data-block-id=\"5165f64\"><p class=\"stk-block-text__text\">Anders liegt es, wenn Verm\u00e4chtnisse den Erbteil aush\u00f6hlen. Ein anderer Vater, ebenfalls verwitwet, hinterl\u00e4sst 400.000 Euro und eine Tochter als einziges Kind. Er setzt sie als Alleinerbin ein, verpflichtet sie aber, seiner Lebensgef\u00e4hrtin 350.000 Euro auszuzahlen. Als Erbin blieben ihr 50.000 Euro. Ihr gesetzlicher Erbteil w\u00e4re der gesamte Nachlass gewesen, ihre Pflichtteilsquote betr\u00e4gt also die H\u00e4lfte. Weil Verm\u00e4chtnisse bei der Berechnung des Pflichtteils nicht vom Nachlass abgezogen werden, sind das 200.000 Euro und damit das Vierfache. Wer nach ihrer Ausschlagung Erbe wird, muss beides bedienen und darf das Verm\u00e4chtnis deshalb anteilig k\u00fcrzen (\u00a7 2318 BGB).<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-5f46f1c\" data-block-id=\"5f46f1c\"><p class=\"stk-block-text__text\">Eine dritte M\u00f6glichkeit wird h\u00e4ufig \u00fcbersehen. Ist der zugedachte Erbteil kleiner als die Pflichtteilsquote, braucht es die Ausschlagung nicht. Dann kann der Berechtigte den Erbteil behalten und zus\u00e4tzlich die Differenz zum vollen Pflichtteil verlangen, den sogenannten Zusatz- oder Restpflichtteil (\u00a7 2305 BGB). Belastungen bleiben bei dieser Rechnung au\u00dfer Betracht, f\u00fcr den Erbteil selbst gelten sie aber weiter.<\/p><\/div>\n\n\n\n<h2 id=\"ausnahme-zwei-das-ausgeschlagene-vermachtnis\" class=\"wp-block-heading\">Ausnahme zwei, das ausgeschlagene Verm\u00e4chtnis<\/h2>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-36a2144\" data-block-id=\"36a2144\"><p class=\"stk-block-text__text\">Manchmal wird ein naher Angeh\u00f6riger nicht Erbe, sondern erh\u00e4lt nur einen einzelnen Verm\u00f6gensvorteil, etwa ein Auto, eine Geldsumme oder ein Wohnrecht. Das ist ein Verm\u00e4chtnis. Wer damit bedacht ist und es annimmt, muss sich den Wert auf seinen Pflichtteil anrechnen lassen und kann nur noch die Differenz verlangen. Schl\u00e4gt er das Verm\u00e4chtnis dagegen aus, steht ihm der ungek\u00fcrzte Pflichtteil zu (\u00a7 2307 BGB). F\u00fcr den \u00fcberlebenden Ehegatten gilt dabei eine Besonderheit, die vom G\u00fcterstand abh\u00e4ngt und im n\u00e4chsten Abschnitt steht.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-f714fd8\" data-block-id=\"f714fd8\"><p class=\"stk-block-text__text\">F\u00fcr diese Ausschlagung gelten die strengen Regeln der Erbausschlagung nicht. Es gibt keine Sechs-Wochen-Frist, solange das Verm\u00e4chtnis nicht angenommen wurde, und die Erkl\u00e4rung wird formlos gegen\u00fcber demjenigen abgegeben, der das Verm\u00e4chtnis erf\u00fcllen muss (\u00a7 2180 BGB). Beliebig lange zuwarten kann man trotzdem nicht. Der beschwerte Erbe darf eine angemessene Frist zur Erkl\u00e4rung setzen. Verstreicht sie, gilt das Verm\u00e4chtnis als ausgeschlagen (\u00a7 2307 Abs. 2 BGB).<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-523d95d\" data-block-id=\"523d95d\"><p class=\"stk-block-text__text\">Die Rechnung geht in der Regel dann auf, wenn das Verm\u00e4chtnis weniger wert ist als der Pflichtteil, oder wenn der zugewandte Gegenstand schwer zu Geld zu machen ist. Bei einem Miteigentumsanteil an einer Immobilie, den niemand kaufen will, ist der schlichte Geldanspruch oft die bessere Position.<\/p><\/div>\n\n\n\n<h2 id=\"ausnahme-drei-der-uberlebende-ehegatte\" class=\"wp-block-heading\">Ausnahme drei, der \u00fcberlebende Ehegatte<\/h2>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-24fbfc7\" data-block-id=\"24fbfc7\"><p class=\"stk-block-text__text\">F\u00fcr Ehegatten gilt eine eigene Regel, die an den G\u00fcterstand ankn\u00fcpft. Sie greift nur, wenn das Paar in der Zugewinngemeinschaft gelebt hat, also keinen Ehevertrag mit G\u00fctertrennung oder G\u00fctergemeinschaft geschlossen hat. Der Zugewinn ist dabei der Verm\u00f6genszuwachs, den jeder der beiden w\u00e4hrend der Ehe erzielt hat.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-0433d50\" data-block-id=\"0433d50\"><p class=\"stk-block-text__text\">Stirbt einer der Ehegatten, wird dieser Zuwachs im Normalfall pauschal ausgeglichen. Der gesetzliche Erbteil des \u00dcberlebenden erh\u00f6ht sich um ein Viertel, ganz gleich, wie viel w\u00e4hrend der Ehe tats\u00e4chlich entstanden ist (\u00a7 1371 Abs. 1 BGB). Schl\u00e4gt er die Erbschaft aus, kann er stattdessen den konkret berechneten Zugewinnausgleich verlangen, und daneben den Pflichtteil, obwohl ihm dieser nach den erbrechtlichen Regeln nicht mehr zust\u00fcnde (\u00a7 1371 Abs. 3 BGB). Dieser Pflichtteil rechnet dann mit dem nicht erh\u00f6hten Erbteil und hei\u00dft deshalb kleiner Pflichtteil.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-7b3d857\" data-block-id=\"7b3d857\"><p class=\"stk-block-text__text\">Wie stark das ins Gewicht f\u00e4llt, zeigt eine Rechnung. Ein Ehepaar lebt in der Zugewinngemeinschaft und hat zwei Kinder, der Nachlass betr\u00e4gt 400.000 Euro. Das Verm\u00f6gen ist zum gr\u00f6\u00dften Teil w\u00e4hrend der Ehe entstanden, der Zugewinn des Verstorbenen liegt bei 300.000 Euro, die Ehefrau hat selbst nichts hinzugewonnen. Ihr steht damit die H\u00e4lfte des \u00dcberschusses zu, also 150.000 Euro. Im Testament ist sie nur zu einem Viertel als Erbin bedacht, das w\u00e4ren 100.000 Euro. Schl\u00e4gt sie aus, erh\u00e4lt sie zun\u00e4chst diese 150.000 Euro. Der Anspruch ist eine Nachlassverbindlichkeit und mindert den Nachlass, aus dem sich der Pflichtteil berechnet. Von den verbleibenden 250.000 Euro steht ihr als kleiner Pflichtteil ein Achtel zu, also 31.250 Euro. Zusammen sind das 181.250 Euro statt 100.000 Euro.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-40ea50d\" data-block-id=\"40ea50d\"><p class=\"stk-block-text__text\">Die Rechnung dreht sich um, sobald der Zugewinn gering war. Wer eine kurze Ehe gef\u00fchrt hat oder selbst mehr hinzugewonnen hat als der Verstorbene, steht mit der pauschalen L\u00f6sung besser. Beide Wege lassen sich nur vergleichen, wenn belastbare Zahlen zum Anfangs- und Endverm\u00f6gen beider Eheleute vorliegen, und daf\u00fcr bleiben sechs Wochen.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-fd6fd28\" data-block-id=\"fd6fd28\"><p class=\"stk-block-text__text\">Wer ohnehin vollst\u00e4ndig enterbt wurde, muss daf\u00fcr nichts erkl\u00e4ren. F\u00fcr ihn gilt dieselbe Rechnung schon von Gesetzes wegen, eine Wahl hat er dann gerade nicht (\u00a7 1371 Abs. 2 BGB). Ebenso liegt es beim Ehegatten, der nur ein Verm\u00e4chtnis erhalten hat und dieses ausschl\u00e4gt. In den ersten drei Monaten nach der Annahme darf er Nachlassschulden ohnehin zur\u00fcckhalten, solange er sich einen \u00dcberblick verschafft. Diese Wege kosten Zeit und Aufwand, daf\u00fcr bleibt alles erhalten, was der Nachlass an Werten enth\u00e4lt. Verbauen kann man sie sich allerdings, etwa durch ein versp\u00e4tetes oder unrichtiges Nachlassverzeichnis.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-b788677\" data-block-id=\"b788677\"><p class=\"stk-block-text__text\">Steht dagegen fest, dass nichts zu holen ist, bleibt die Ausschlagung der einfachere Weg. Nur bringt sie eben kein Geld.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-4e36048\" data-block-id=\"4e36048\"><p class=\"stk-block-text__text\">F\u00fcr die Entscheidung braucht es einen \u00dcberblick, und den liefern in der kurzen Frist meist die Kontoausz\u00fcge der letzten Monate, die laufende Post, Kredit- und Versicherungsunterlagen, ein Grundbuchauszug und offene Rechnungen. Solange nicht ausgeschlagen ist, ist man Erbe und kann solche Ausk\u00fcnfte einholen. Nachforschen allein gilt in der Regel noch nicht als Annahme der Erbschaft. \u00dcber Nachlassgegenst\u00e4nde zu verf\u00fcgen dagegen schon.<\/p><\/div>\n\n\n\n<h2 id=\"frist-form-und-kosten\" class=\"wp-block-heading\">Frist, Form und Kosten<\/h2>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-d949a58\" data-block-id=\"d949a58\"><p class=\"stk-block-text__text\">Die Frist betr\u00e4gt sechs Wochen. Sie beginnt, sobald Sie sowohl vom Tod als auch davon wissen, dass und warum Sie Erbe geworden sind. Beruht Ihre Erbenstellung auf einem Testament oder Erbvertrag, l\u00e4uft sie fr\u00fchestens ab der Bekanntgabe der Verf\u00fcgung durch das Nachlassgericht (\u00a7 1944 Abs. 2 BGB). Hatte der Verstorbene seinen letzten Wohnsitz nur im Ausland oder halten Sie sich bei Fristbeginn im Ausland auf, sind es sechs Monate. Verl\u00e4ngern l\u00e4sst sich die Frist nicht. L\u00e4uft sie ab, gilt die Erbschaft als angenommen (\u00a7 1943 BGB).<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-6597977\" data-block-id=\"6597977\"><p class=\"stk-block-text__text\">Entscheidend ist nicht, wann Sie unterschreiben, sondern wann die Erkl\u00e4rung beim Nachlassgericht ankommt. Wer erst am letzten Tag zum Notar geht, hat das Risiko des Postwegs damit nicht abgewendet. Seit dem 29. Dezember 2025 d\u00fcrfen Notare ihre Urkunden allerdings vollst\u00e4ndig elektronisch errichten und dem Gericht unmittelbar elektronisch \u00fcbermitteln. Pers\u00f6nlich erscheinen m\u00fcssen Sie beim Notar weiterhin, eine Ausschlagung per Videokonferenz gibt es nicht.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-2b59487\" data-block-id=\"2b59487\"><p class=\"stk-block-text__text\">Die Form ist eng. Zul\u00e4ssig sind nur zwei Wege. Entweder erkl\u00e4ren Sie die Ausschlagung direkt beim Nachlassgericht zur Niederschrift, wobei das Gericht bei der Formulierung hilft. Oder Sie geben die Erkl\u00e4rung in \u00f6ffentlich beglaubigter Form ab, also mit notariell beglaubigter Unterschrift. Ein selbst verfasstes Schreiben gen\u00fcgt nicht, eine E-Mail ebenso wenig, und auch ein anwaltlicher Schriftsatz ersetzt die Beglaubigung nicht. Wer sich vertreten l\u00e4sst, braucht eine \u00f6ffentlich beglaubigte Vollmacht, die der Erkl\u00e4rung beiliegen oder innerhalb der Frist nachgereicht werden muss (\u00a7 1945 Abs. 3 BGB).<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-b328e37\" data-block-id=\"b328e37\"><p class=\"stk-block-text__text\">Zust\u00e4ndig ist das Amtsgericht als Nachlassgericht an dem Ort, an dem der Verstorbene zuletzt seinen gew\u00f6hnlichen Aufenthalt hatte (\u00a7 343 Abs. 1 FamFG). Das ist nicht zwingend die gemeldete Adresse, bei Heimbewohnern regelm\u00e4\u00dfig der Ort des Heims. Eine weite Anreise ist deswegen nicht n\u00f6tig, denn die Erkl\u00e4rung nimmt auch das Nachlassgericht an Ihrem eigenen gew\u00f6hnlichen Aufenthalt entgegen (\u00a7 344 Abs. 7 FamFG).<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-a7f6a33\" data-block-id=\"a7f6a33\"><p class=\"stk-block-text__text\">Kostenfrei ist die Ausschlagung an keiner der beiden Stellen. F\u00e4llig wird eine halbe Geb\u00fchr, die sich nach dem Wert des eigenen Erbteils abz\u00fcglich der Schulden richtet, mindestens jedoch 30 Euro (Nummer 21201 KV GNotKG, \u00a7 103 GNotKG). Bei einem \u00fcberschuldeten Nachlass bleibt es deshalb bei 30 Euro. Bei einem Erbteil von 50.000 Euro sind es 82,50 Euro, bei 100.000 Euro 136,50 Euro. Wird beim Notar nur die Unterschrift unter einen fertigen Text beglaubigt, liegt die Geb\u00fchr zwischen 20 und 70 Euro, formuliert er die Erkl\u00e4rung selbst, kommt eine Entwurfsgeb\u00fchr hinzu. F\u00fcr jede ausschlagende Person entstehen die Kosten gesondert, also auch f\u00fcr jedes Kind, f\u00fcr das mit ausgeschlagen wird.<\/p><\/div>\n\n\n\n<h2 id=\"wer-nachruckt-und-wie-der-pflichtteil-dann-durchgesetzt-wird\" class=\"wp-block-heading\">Wer nachr\u00fcckt und wie der Pflichtteil dann durchgesetzt wird<\/h2>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-ff9507e\" data-block-id=\"ff9507e\"><p class=\"stk-block-text__text\">Nach einer wirksamen Ausschlagung f\u00e4llt die Erbschaft demjenigen zu, der berufen w\u00e4re, wenn es den Ausschlagenden nicht gegeben h\u00e4tte (\u00a7 1953 Abs. 2 BGB). Sieht das Testament einen Ersatzerben vor, ist es dieser. Andernfalls greift die gesetzliche Reihenfolge, und dann sind es sehr oft die eigenen Kinder. Schlagen am Ende alle aus, erbt der Staat, und der kann die Erbschaft nicht ausschlagen (\u00a7\u00a7 1936, 1942 Abs. 2 BGB).<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-e8540e9\" data-block-id=\"e8540e9\"><p class=\"stk-block-text__text\">Genau hier bleiben Ausschlagungen oft auf halbem Weg stehen. Wer nur f\u00fcr sich selbst erkl\u00e4rt, hat das Problem eine Generation weitergereicht. F\u00fcr minderj\u00e4hrige Kinder m\u00fcssen die sorgeberechtigten Eltern gesondert erkl\u00e4ren, und f\u00fcr jedes Kind l\u00e4uft dabei eine eigene Frist. Eine Genehmigung des Familiengerichts brauchen sie daf\u00fcr nicht, wenn das Kind erst durch die Ausschlagung eben dieses Elternteils zum Zuge kommt und der Elternteil nicht neben dem Kind berufen war (\u00a7 1643 Abs. 3 BGB). R\u00fcckt das Kind dagegen nach, weil ein Dritter ausgeschlagen hat, etwa ein Gro\u00dfelternteil, bleibt es bei der Genehmigungspflicht.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-2b5d293\" data-block-id=\"2b5d293\"><p class=\"stk-block-text__text\">Wer seinen Erbteil ausgeschlagen hat, richtet den Pflichtteil anschlie\u00dfend gegen genau diese nachger\u00fcckten Erben. Das k\u00f6nnen die eigenen Geschwister sein, mitunter auch die eigenen Kinder. Wer dagegen nur ein Verm\u00e4chtnis ausgeschlagen hat, war nie Erbe, dort bleiben die Erben dieselben. Um den Anspruch beziffern zu k\u00f6nnen, gibt es in beiden F\u00e4llen einen Auskunftsanspruch gegen die Erben, auf Verlangen auch auf ein notarielles Nachlassverzeichnis (\u00a7 2314 BGB). Der Anspruch selbst entsteht mit dem Erbfall und ist sofort f\u00e4llig, in den ersten drei Monaten nach der Annahme darf der Erbe die Zahlung allerdings zur\u00fcckhalten (\u00a7\u00a7 2317, 2014 BGB). Verj\u00e4hrt ist er nach drei Jahren, gerechnet ab dem Ende des Jahres, in dem der Berechtigte von Erbfall, Enterbung und der Person des Erben erfahren hat.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-212984e\" data-block-id=\"212984e\"><p class=\"stk-block-text__text\">Zwei Punkte verschieben die Summe. Hat der Verstorbene zu Lebzeiten verschenkt, kommt ein Erg\u00e4nzungsanspruch hinzu. Ber\u00fccksichtigt werden Schenkungen der letzten zehn Jahre, allerdings abgestuft, weil eine Schenkung f\u00fcr jedes weitere zur\u00fcckliegende Jahr um ein Zehntel weniger z\u00e4hlt. Bei Schenkungen unter Ehegatten beginnt diese Frist erst mit dem Ende der Ehe, dort z\u00e4hlen die Zuwendungen also unbegrenzt mit (\u00a7 2325 BGB). Umgekehrt k\u00f6nnen fr\u00fchere Zuwendungen den Pflichtteil mindern, aber nur, wenn der Erblasser die Anrechnung sp\u00e4testens bei der Zuwendung selbst bestimmt hat. Sp\u00e4ter, etwa erst im Testament, l\u00e4sst sich das nicht nachholen (\u00a7 2315 BGB).<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-6e5e25d\" data-block-id=\"6e5e25d\"><p class=\"stk-block-text__text\">Zahlt der Erbe nicht freiwillig, wird der Anspruch vor dem Zivilgericht geltend gemacht, in der Praxis meist als Stufenklage, die zuerst Auskunft und dann Zahlung verlangt. Das kostet Zeit, und bei Immobilien im Nachlass kommen Gutachterkosten hinzu, die zun\u00e4chst vorzustrecken sind.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-b510f9b\" data-block-id=\"b510f9b\"><p class=\"stk-block-text__text\">Steuerlich gilt eine Besonderheit, die oft \u00fcbersehen wird. Der Pflichtteil wird erst dann erbschaftsteuerpflichtig, wenn er geltend gemacht wird, nicht schon mit dem Erbfall. Wird f\u00fcr eine Ausschlagung eine Abfindung gezahlt, etwa weil sich die Familie au\u00dfergerichtlich einigt, unterliegt diese Abfindung der Erbschaftsteuer wie ein Erwerb vom Verstorbenen (\u00a7 3 Abs. 2 Nr. 4 ErbStG). Schwierig wird es, wenn die Auskunft unvollst\u00e4ndig bleibt, der Wert einer Immobilie zu niedrig angesetzt wird oder sich die Sache \u00fcber Jahre hinzieht. Genau dann unterst\u00fctzt Erbfinanz. class=\"wp-block-stackable-text stk-block-text stk-block stk-3f19c64\" data-block-id=\"3f19c64\"><p class=\"stk-block-text__text\">Am teuersten ist die Ausschlagung in der Annahme, den Pflichtteil dadurch zu retten. Ob sich das noch korrigieren l\u00e4sst, h\u00e4ngt davon ab, wor\u00fcber genau der Irrtum bestand. Der Verlust des Pflichtteils ist eine unmittelbare Folge der Ausschlagung, und ein Irrtum dar\u00fcber kann zur Anfechtung berechtigen. Der Bundesgerichtshof hat das f\u00fcr die spiegelbildliche Lage entschieden, in der jemand die Erbschaft annahm und dadurch seinen Pflichtteil verlor (Urteil vom 29. Juni 2016, IV ZR 387\/15). Wer sich dagegen nur dar\u00fcber geirrt hat, wer nach ihm erben w\u00fcrde, kommt aus der Erkl\u00e4rung nicht mehr heraus. Das ist nach dem Bundesgerichtshof ein blo\u00dfer Beweggrund, der eine Anfechtung nicht tr\u00e4gt (Beschluss vom 22. M\u00e4rz 2023, IV ZB 12\/22).<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-10c3110\" data-block-id=\"10c3110\"><p class=\"stk-block-text__text\">Fast ebenso h\u00e4ufig ist die stillschweigende Annahme. Wer sich wie ein Erbe verh\u00e4lt, etwa einen Erbschein beantragt, Konten aufl\u00f6st oder Gegenst\u00e4nde aus dem Nachlass verkauft, nimmt die Erbschaft damit an und kann anschlie\u00dfend nicht mehr ausschlagen. Die Beerdigung zu organisieren und die Wohnung zu sichern geh\u00f6rt nicht dazu, die Grenze ist aber enger gezogen, als viele denken. Der dritte Klassiker betrifft die Form. Ein fristgerechter Brief an das Nachlassgericht ohne Beglaubigung ist unwirksam, und ist die Frist inzwischen abgelaufen, hilft er nicht mehr.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-fe72bda\" data-block-id=\"fe72bda\"><p class=\"stk-block-text__text\">Verbreitet ist auch die Vorstellung, mit der Ausschlagung sei jede Verantwortung erledigt. Von der Bestattungspflicht befreit sie nicht. Diese folgt aus dem Bestattungsgesetz des jeweiligen Bundeslandes und trifft nahe Angeh\u00f6rige unabh\u00e4ngig davon, ob sie Erben sind. Tragen muss die Kosten am Ende zwar der Erbe (\u00a7 1968 BGB), doch wer bestattungspflichtig ist, zahlt zun\u00e4chst selbst. Ist der Nachlass \u00fcberschuldet, kommt eine \u00dcbernahme durch den Sozialhilfetr\u00e4ger in Betracht, soweit die Kosten dem Verpflichteten nicht zuzumuten sind (\u00a7 74 SGB XII).<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-fd320a8\" data-block-id=\"fd320a8\"><p class=\"stk-block-text__text\">Bleibt der Notausgang, wenn eine Ausschlagung erkl\u00e4rt ist und sich die Lage anders darstellt als gedacht. Die Anfechtung ist binnen sechs Wochen ab Kenntnis des Anfechtungsgrundes zu erkl\u00e4ren, bei Auslandsbezug binnen sechs Monaten, in derselben Form wie die Ausschlagung selbst, und sie gilt dann als Annahme (\u00a7\u00a7 1954 bis 1957 BGB). Neben dem beschriebenen Irrtum \u00fcber den Pflichtteil tr\u00e4gt sie vor allem ein Irrtum \u00fcber die Zusammensetzung des Nachlasses, etwa wenn eine erhebliche Forderung oder ein unbekanntes Konto erst sp\u00e4ter auftaucht. Eine blo\u00dfe Fehleinsch\u00e4tzung des Wertes gen\u00fcgt nicht. Auch die vers\u00e4umte Ausschlagungsfrist l\u00e4sst sich anfechten, wenn die Vers\u00e4umung selbst auf einem Irrtum beruht (\u00a7 1956 BGB). Beim belasteten Erbteil beginnt die Frist erst, wenn Sie von der Belastung wissen. Verl\u00e4ngern l\u00e4sst sich die Frist nicht.<\/p><\/div>\n\n\n\n<h3 id=\"wie-hoch-ist-mein-pflichtteil\" class=\"wp-block-heading\">Wie hoch ist mein Pflichtteil?<\/h3>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-a154b92\" data-block-id=\"a154b92\"><p class=\"stk-block-text__text\">Er betr\u00e4gt die H\u00e4lfte dessen, was Ihnen ohne Testament zugestanden h\u00e4tte. Bei zwei Kindern und verwitwetem Elternteil ist das ein Viertel des Nachlasswertes je Kind, bei einem einzigen Kind die H\u00e4lfte.<\/p><\/div>\n\n\n\n<h3 id=\"was-kostet-die-ausschlagung\" class=\"wp-block-heading\">Was kostet die Ausschlagung?<\/h3>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-425e5ea\" data-block-id=\"425e5ea\"><p class=\"stk-block-text__text\">Bei \u00fcberschuldetem Nachlass 30 Euro. Sonst eine halbe Geb\u00fchr nach dem Wert Ihres Erbteils, bei 100.000 Euro also 136,50 Euro. Eine reine Unterschriftsbeglaubigung beim Notar liegt zwischen 20 und 70 Euro.<\/p><\/div>\n\n\n\n<h3 id=\"muss-ich-fur-meine-kinder-gesondert-ausschlagen\" class=\"wp-block-heading\">Muss ich f\u00fcr meine Kinder gesondert ausschlagen?<\/h3>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-918f6bc\" data-block-id=\"918f6bc\"><p class=\"stk-block-text__text\">R\u00fccken die Kinder durch Ihre Ausschlagung nach, wird f\u00fcr sie eine eigene Erkl\u00e4rung f\u00e4llig, bei Minderj\u00e4hrigen durch die sorgeberechtigten Eltern. Daf\u00fcr bleiben sechs Wochen ab Kenntnis, und es gilt dieselbe Form wie bei der Ausschlagung.<\/p><\/div>\n\n\n\n<h2 id=\"worauf-es-am-ende-ankommt\" class=\"wp-block-heading\">Worauf es am Ende ankommt<\/h2>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-410e358\" data-block-id=\"410e358\"><p class=\"stk-block-text__text\">Die Ausschlagung wirkt in beide Richtungen. Sie sch\u00fctzt vor Schulden, und sie kostet Rechte. Etwas einbringen kann sie nur in den drei beschriebenen Lagen, also wenn das Testament die Erbenstellung so weit einschn\u00fcrt, dass der Pflichtteil in Geld mehr wert ist als ein gebundener Anteil am Nachlass, wenn ein Verm\u00e4chtnis hinter dem Pflichtteil zur\u00fcckbleibt, und beim \u00fcberlebenden Ehegatten mit hohem Zugewinn. In jedem anderen Fall gibt man mit dem Erbe auch den Pflichtteil ab.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-e9abf67\" data-block-id=\"e9abf67\"><p class=\"stk-block-text__text\">Ob der eigene Fall dazugeh\u00f6rt, entscheidet sich am Wortlaut des Testaments und, bei Ehegatten, am G\u00fcterstand.
