F\u00fcr ein Konto gibt es eine Bank, die Auskunft erteilen kann. Ein Auto ist zugelassen, ein Firmenanteil steht im Handelsregister. F\u00fcr ein Gem\u00e4lde gibt es nichts davon. Kein Eigentumsregister, keine amtliche Wertauskunft, keine Stelle, die verbindlich feststellt, was ein Werk wert ist. Dazu kommt, dass ein Bild in wenigen Minuten aus einer Wohnung getragen ist. Wer enterbt wurde und wei\u00df oder vermutet, dass in der Wohnung Bilder oder andere Wertgegenst\u00e4nde waren, steht damit vor einer besonderen Lage. Der Pflichtteil ist ein Anspruch auf Geld. Seine H\u00f6he h\u00e4ngt aber an Gegenst\u00e4nden, deren Wert erst feststeht, wenn jemand sie verkauft. \u00dcber diesen Moment entscheidet der Erbe.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-bda1980\" data-block-id=\"bda1980\"><p class=\"stk-block-text__text\">Wie weit die Zahlen dabei auseinandergehen k\u00f6nnen, beschreibt eine \u00f6ffentlich bestellte Sachverst\u00e4ndige f\u00fcr Kunst sehr direkt. Beim Ankauf biete ein H\u00e4ndler etwa zehn Prozent des Versicherungswertes. Zwischen der Summe in der Versicherungspolice und dem Betrag, der am Ende tats\u00e4chlich flie\u00dft, liegt danach eine ganze Gr\u00f6\u00dfenordnung.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-49eb52d\" data-block-id=\"49eb52d\"><p class=\"stk-block-text__text\">Wie weit es im Extremfall gehen kann, zeigt ein Fall, \u00fcber den in der Fachpresse berichtet wurde. Zwei Gem\u00e4lde aus einem Nachlass bewertete ein Gerichtsgutachter mit null Euro, weil ihre Echtheit nicht gekl\u00e4rt war. Elf Jahre sp\u00e4ter wurde eines der beiden Bilder f\u00fcr vier Millionen Euro verkauft. F\u00fcr die Berechnung des Pflichtteils blieb der Wert zum Todestag ma\u00dfgeblich.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-b1e53f7\" data-block-id=\"b1e53f7\"><p class=\"stk-block-text__text\">Dieser Beitrag beschreibt, wie der Wert solcher Gegenst\u00e4nde f\u00fcr den Pflichtteil ermittelt wird und was sich an Auskunft verlangen l\u00e4sst. Er wird auch nicht Miteigent\u00fcmer an dem, was der Verstorbene hinterlassen hat. Das Gesetz gibt ihm stattdessen einen Anspruch auf Geld gegen die Erben, in H\u00f6he der H\u00e4lfte dessen, was ihm ohne Testament als gesetzlichem Erben zugefallen w\u00e4re (\u00a7 2303 BGB). Wie sich diese Quote im Einzelnen berechnet, ist in einem eigenen Ratgeber beschrieben.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-e0fbb32\" data-block-id=\"e0fbb32\"><p class=\"stk-block-text__text\">F\u00fcr Kunst hat das eine Folge, die viele \u00fcberrascht. Der Anspruch richtet sich nie auf ein bestimmtes Werk. Es gibt kein Recht, sich ein Bild aus der Sammlung auszusuchen, und auch keines, statt Geld die Herausgabe eines Gegenstands zu verlangen. Das gilt selbst dann, wenn der Nachlass praktisch nur aus Bildern besteht.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-c599e3a\" data-block-id=\"c599e3a\"><p class=\"stk-block-text__text\">Daraus folgt der Gedanke, der diesen ganzen Beitrag tr\u00e4gt. Weil der Pflichtteil eine Geldsumme ist, muss jemand beziffern, was die Gegenst\u00e4nde wert sind. Bei einem Sparbuch steht die Zahl auf dem Kontoauszug. Bei einem Reihenhaus gibt es Vergleichspreise und Bodenrichtwerte. Bei einem \u00d6lgem\u00e4lde gibt es eine Einsch\u00e4tzung, dann eine zweite, und beide k\u00f6nnen weit auseinanderliegen.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-7c3f04e\" data-block-id=\"7c3f04e\"><p class=\"stk-block-text__text\">Der Streit in solchen F\u00e4llen dreht sich deshalb selten um die Quote. Er dreht sich fast immer um zwei andere Fragen. Was war \u00fcberhaupt da, und was war es wert. Beide Fragen behandelt dieser Beitrag der Reihe nach.<\/p><\/div>\n\n\n\n<h2 id=\"was-ein-bild-fur-den-pflichtteil-wert-ist\" class=\"wp-block-heading\">Was ein Bild f\u00fcr den Pflichtteil wert ist<\/h2>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-7375f9d\" data-block-id=\"7375f9d\"><p class=\"stk-block-text__text\">Gerechnet wird mit dem Wert, den die Gegenst\u00e4nde am Todestag hatten. Was danach passiert, spielt grunds\u00e4tzlich keine Rolle. Steigt der Markt f\u00fcr einen K\u00fcnstler nach dem Erbfall stark an, profitiert der Pflichtteilsberechtigte davon nicht. Bricht der Markt ein, schadet ihm das nicht.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-173d449\" data-block-id=\"173d449\"><p class=\"stk-block-text__text\">Welcher Wert damit gemeint ist, hat der Bundesgerichtshof beschrieben. Der Pflichtteilsberechtigte soll wirtschaftlich so stehen, als w\u00e4re der Nachlass beim Tod des Erblassers in Geld umgesetzt worden. Gesucht ist also der Verkehrswert. Damit ist der Preis gemeint, der sich bei einem Verkauf am freien Markt h\u00e4tte erzielen lassen. Nicht gemeint ist der Betrag, den eine Versicherung im Schadensfall zahlen w\u00fcrde. Und erst recht nicht der Wert, den ein Bild f\u00fcr die Familie hat.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-e5d4298\" data-block-id=\"e5d4298\"><p class=\"stk-block-text__text\">Zwei Angaben sind f\u00fcr diese Rechnung ohne Bedeutung.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-161794c\" data-block-id=\"161794c\"><p class=\"stk-block-text__text\">Die erste ist die Wertangabe des Erblassers. Steht im Testament, ein Bild sei 20.000 Euro wert, bindet das niemanden. Das Gesetz sagt ausdr\u00fccklich, dass eine vom Erblasser getroffene Wertbestimmung nicht ma\u00dfgebend ist. Wo es n\u00f6tig ist, wird der Wert gesch\u00e4tzt.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-c45dea9\" data-block-id=\"c45dea9\"><p class=\"stk-block-text__text\">Die zweite ist der Kaufpreis.<\/p><\/div>\n\n\n\n<h3 id=\"wenn-ein-flohmarktfund-400-000-euro-wert-ist\" class=\"wp-block-heading\">Wenn ein Flohmarktfund 400.000 Euro wert ist<\/h3>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-f7bfb1c\" data-block-id=\"f7bfb1c\"><p class=\"stk-block-text__text\">Es kommt nicht darauf an, was der Erblasser f\u00fcr ein Werk bezahlt hat. Ma\u00dfgeblich ist allein, was es am Todestag wert war.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-410f9a7\" data-block-id=\"410f9a7\"><p class=\"stk-block-text__text\">Das wirkt in beide Richtungen. Ein Bild, das vor drei\u00dfig Jahren f\u00fcr 50 Euro auf einem Flohmarkt gekauft wurde und am Todestag 400.000 Euro wert ist, geht mit 400.000 Euro in die Rechnung ein. Umgekehrt ist der Satz \u201edas hat mein Vater damals f\u00fcr fast nichts bekommen&#8220; rechtlich ohne Gewicht. Auch fehlende Kaufbelege sprechen nicht gegen einen hohen Wert. Bei Kunst bestimmen wenige Faktoren den Preis, und kleine Unterschiede bewegen dort gro\u00dfe Betr\u00e4ge.<\/p><\/div>\n\n\n\n<h3 id=\"ein-einziges-wort-im-katalog\" class=\"wp-block-heading\">Ein einziges Wort im Katalog<\/h3>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-b768d50\" data-block-id=\"b768d50\"><p class=\"stk-block-text__text\">Auktionsh\u00e4user arbeiten mit einer abgestuften Sprache. Sie legt fest, wie sicher ein Werk einem K\u00fcnstler zugeordnet wird, im Kunsthandel Zuschreibung genannt. Ganz oben steht das signierte Werk. Darunter beginnen die Abstufungen, in einem deutschen Katalog unter anderem so:<\/p><\/div>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>zugeschrieben:<\/strong> \u201eUnserer Meinung nach wahrscheinlich in G\u00e4nze oder in Teilen ein Werk des angegebenen K\u00fcnstlers.&#8220;<\/li>\n\n\n\n<li><strong>Werkstatt:<\/strong> \u201eaus der Werkstatt des angegebenen K\u00fcnstlers, vermutlich unter seiner Aufsicht.&#8220;<\/li>\n\n\n\n<li><strong>Umkreis:<\/strong> \u201eein zeitgen\u00f6ssisches Werk, das den Einfluss des angegebenen K\u00fcnstlers zeigt.&#8220;<\/li>\n\n\n\n<li><strong>nach:<\/strong> \u201eeine Kopie eines Werkes des angegebenen K\u00fcnstlers.&#8220;<\/li>\n<\/ul>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-5fadece\" data-block-id=\"5fadece\"><p class=\"stk-block-text__text\">Auff\u00e4llig ist die Konstruktion. Jede Stufe ist als Meinung formuliert, nicht als Feststellung. Das begrenzt die Haftung des Hauses. F\u00fcr den Wert bedeutet es, dass ein einziges Wort die Zurechnung verschiebt und damit den Preis. Wie gro\u00df der Abstand zwischen den Stufen ausf\u00e4llt, ver\u00f6ffentlicht kein Auktionshaus.<\/p><\/div>\n\n\n\n<h3 id=\"echtheit-werkverzeichnis-und-herkunft\" class=\"wp-block-heading\">Echtheit, Werkverzeichnis und Herkunft<\/h3>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-1923e58\" data-block-id=\"1923e58\"><p class=\"stk-block-text__text\">Wie viel an der Echtheit h\u00e4ngt, zeigt ein Urteil eines Landgerichts. Ein Auktionshaus musste einem K\u00e4ufer rund zwei Millionen Euro zur\u00fcckzahlen, weil ein f\u00fcr knapp drei Millionen Euro verkauftes Bild eine F\u00e4lschung war. Das Haus habe die Zuschreibung ohne ausreichende Grundlage vorgenommen, befand das Gericht, und h\u00e4tte sich bei dieser Gr\u00f6\u00dfenordnung nicht allein auf die kunsthistorische Betrachtung verlassen d\u00fcrfen.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-a3dee02\" data-block-id=\"a3dee02\"><p class=\"stk-block-text__text\">Seither sind Auktionsh\u00e4user bei Werken ohne belegte Herkunft sehr zur\u00fcckhaltend. Ein Bild, dessen Echtheit sich nicht belegen l\u00e4sst, liegt im Wert oft n\u00e4her an null als an einem vergleichbaren gesicherten Werk.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-813bd81\" data-block-id=\"813bd81\"><p class=\"stk-block-text__text\">\u00c4hnlich wirken Werkverzeichnis und Echtheitszertifikat. Sie steigern den Wert nicht, sondern sind Voraussetzung daf\u00fcr, dass ein Werk \u00fcberhaupt handelbar ist. Ihr Fehlen vernichtet Wert, ihr Vorhandensein schafft keinen zus\u00e4tzlichen. Und ein Werk, das in einer Auktion nicht verkauft wurde, gilt danach als schwerer verk\u00e4uflich.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-ba66756\" data-block-id=\"ba66756\"><p class=\"stk-block-text__text\">Dasselbe gilt f\u00fcr die Herkunftskette, im Kunsthandel Provenienz genannt. Eine L\u00fccke, besonders in den Jahren zwischen 1933 und 1945, dr\u00fcckt den Preis, unabh\u00e4ngig davon, ob jemand Anspr\u00fcche stellt. F\u00fcr private Nachl\u00e4sse ist dabei eine Einschr\u00e4nkung wichtig. Das seit Ende 2025 arbeitende Schiedsgericht f\u00fcr NS-Raubgut richtet sich an \u00f6ffentliche Tr\u00e4ger, private Eigent\u00fcmer sind nicht erfasst. Das Risiko wirkt trotzdem, weil kein Haus und kein K\u00e4ufer es anders behandelt. Wie stark eine L\u00fccke den Preis dr\u00fcckt, l\u00e4sst sich nicht allgemein sagen. Wie aufwendig eine Kl\u00e4rung ist, zeigt der bekannteste deutsche Fall der letzten Jahre. Von rund 1.500 beschlagnahmten Werken wurden am Ende 14 zur\u00fcckgegeben.<\/p><\/div>\n\n\n\n<h3 id=\"was-am-markt-tatsachlich-passiert\" class=\"wp-block-heading\">Was am Markt tats\u00e4chlich passiert<\/h3>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-1d2a3b7\" data-block-id=\"1d2a3b7\"><p class=\"stk-block-text__text\">Zu einer ehrlichen Einordnung geh\u00f6rt auch die andere Seite. Rund ein Drittel aller Auktionslose bleibt unverkauft, und \u00fcber neunzig Prozent der Lose werden f\u00fcr vergleichsweise kleine Betr\u00e4ge zugeschlagen. Nur ein sehr kleiner Teil erreicht die Summen, die in Zeitungsberichten vorkommen.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-3b9e32e\" data-block-id=\"3b9e32e\"><p class=\"stk-block-text__text\">Eine geerbte Sammlung ist also nicht automatisch ein Verm\u00f6gen. Der Aufwand lohnt sich dort, wo einzelne Werke wirklich hohe Werte haben, und genau dort ist die Bewertung dann besonders umstritten.<\/p><\/div>\n\n\n\n<h3 id=\"wenn-die-echtheit-am-todestag-offen-ist\" class=\"wp-block-heading\">Wenn die Echtheit am Todestag offen ist<\/h3>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-c19c087\" data-block-id=\"c19c087\"><p class=\"stk-block-text__text\">Bleibt am Todestag ungekl\u00e4rt, ob ein Werk echt ist, entsteht ein besonderes Problem. Der Stichtag ist starr, die Kl\u00e4rung dauert oft Jahre. F\u00fcr Werte, die zu diesem Zeitpunkt noch unsicher sind, sieht das Gesetz allerdings einen eigenen Weg vor. Sie bleiben zun\u00e4chst au\u00dfer Ansatz, der Erbe muss sich aber um ihre Kl\u00e4rung k\u00fcmmern, und wenn sich die Frage sp\u00e4ter kl\u00e4rt, wird nachtr\u00e4glich abgerechnet.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-429c14b\" data-block-id=\"429c14b\"><p class=\"stk-block-text__text\">Ein Zuschreibungsstreit muss also nicht bedeuten, dass ein Werk dauerhaft mit null anzusetzen ist. Ob dieser Weg bei einem Bild mit strittiger Zuschreibung greift, ist bislang nicht durch Rechtsprechung gekl\u00e4rt. Verl\u00e4sslich beurteilen l\u00e4sst sich das nur im Einzelfall und nur mit anwaltlicher Pr\u00fcfung.<\/p><\/div>\n\n\n\n<h2 id=\"was-sie-uber-den-nachlass-erfahren-konnen\" class=\"wp-block-heading\">Was Sie \u00fcber den Nachlass erfahren k\u00f6nnen<\/h2>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-e7211dd\" data-block-id=\"e7211dd\"><p class=\"stk-block-text__text\">Wer nicht Erbe geworden ist, hat keinen Schl\u00fcssel zur Wohnung und keinen Zugriff auf Unterlagen. Er ist auf Informationen anderer angewiesen. Das Gesetz gibt ihm daf\u00fcr mehrere Werkzeuge (\u00a7 2314 BGB):<\/p><\/div>\n\n\n\n<ul class=\"wp-block-list\">\n<li>ein Nachlassverzeichnis, also eine Aufstellung, in der der Erbe alle Gegenst\u00e4nde und Schulden des Nachlasses auff\u00fchrt,<\/li>\n\n\n\n<li>das Recht, bei der Aufnahme dieses Verzeichnisses dabei zu sein,<\/li>\n\n\n\n<li>eine Wertermittlung, also die Sch\u00e4tzung der Gegenst\u00e4nde durch einen Sachverst\u00e4ndigen,<\/li>\n\n\n\n<li>die M\u00f6glichkeit, das Verzeichnis nicht vom Erben selbst, sondern von einem Notar aufnehmen zu lassen.<\/li>\n<\/ul>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-cbcb646\" data-block-id=\"cbcb646\"><p class=\"stk-block-text__text\">Die Kosten daf\u00fcr fallen grunds\u00e4tzlich dem Nachlass zur Last, nicht dem Pflichtteilsberechtigten pers\u00f6nlich. Bei einem sehr kleinen Nachlass kann davon eine Ausnahme gelten. Die Voraussetzungen daf\u00fcr muss der Erbe nachweisen. Wie sich Auskunftsanspr\u00fcche in der Praxis durchsetzen lassen, wenn nichts passiert, ist an anderer Stelle beschrieben.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-0ec5fe4\" data-block-id=\"0ec5fe4\"><p class=\"stk-block-text__text\">An dieser Stelle sind zwei Punkte wichtig, die h\u00e4ufig anders erwartet werden.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-5c10c6d\" data-block-id=\"5c10c6d\"><p class=\"stk-block-text__text\">Erstens sucht der Erbe den Sachverst\u00e4ndigen aus. Ein bestimmter Gutachter l\u00e4sst sich nicht fordern. Der Bundesgerichtshof hat au\u00dferdem entschieden, dass kein Anspruch auf einen \u00f6ffentlich bestellten und vereidigten Sachverst\u00e4ndigen besteht. Entscheidend ist, dass er unparteiisch und fachlich geeignet ist.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-e277e26\" data-block-id=\"e277e26\"><p class=\"stk-block-text__text\">Zweitens legt dieses Gutachten den Wert nicht verbindlich fest. Es soll dem Berechtigten erm\u00f6glichen, seine Lage und sein Risiko einzusch\u00e4tzen. Wird sp\u00e4ter \u00fcber die Zahlung gestritten, wird der Wert erneut gepr\u00fcft. Dann kann ein Gerichtsgutachten beantragt oder auf eigene Kosten ein eigenes Gutachten vorgelegt werden.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-3bb2809\" data-block-id=\"3bb2809\"><p class=\"stk-block-text__text\">Bei Kunst kommt eine Besonderheit hinzu, die zun\u00e4chst entt\u00e4uschend klingt. Weil sich der Wert von Kunst nach der Rechtsprechung nur beschr\u00e4nkt objektivieren l\u00e4sst, sind die Anforderungen an das Gutachten geringer als etwa bei einer Immobilie. Einsch\u00e4tzungen renommierter Auktionsh\u00e4user k\u00f6nnen gen\u00fcgen. Weichen zwei Einsch\u00e4tzungen deutlich voneinander ab, gilt das nicht als Mangel, sondern als Ausdruck dieser Unsicherheit. Ein drittes Gutachten l\u00e4sst sich in der Regel nicht verlangen, und ein Gutachten nach den eigenen Wertvorstellungen ohnehin nicht.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-d082e16\" data-block-id=\"d082e16\"><p class=\"stk-block-text__text\">Diese Regel betrifft allerdings nur die Frage, wann die Auskunftspflicht erf\u00fcllt ist. F\u00fcr den sp\u00e4teren Streit \u00fcber die Zahlung sagt sie nichts. Dort ist der Wert frei zu beweisen. Und Sch\u00e4tzpreise aus Auktionskatalogen sind erfahrungsgem\u00e4\u00df bewusst zur\u00fcckhaltend angesetzt.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-f7f0555\" data-block-id=\"f7f0555\"><p class=\"stk-block-text__text\">Zwei Punkte werden dabei oft f\u00fcr erledigt gehalten. Hat der Erbe die Sammlung nach dem Tod bereits verkauft, entf\u00e4llt der Anspruch auf eine Wertermittlung nicht. Der Bundesgerichtshof hat das damit begr\u00fcndet, dass sich sonst ein Verkauf unter Wert nicht \u00fcberpr\u00fcfen lie\u00dfe. Und wird ein Werk bald nach dem Tod verkauft, ist der erzielte Preis nach der Rechtsprechung ein wesentlicher Anhaltspunkt f\u00fcr den Wert am Todestag. Das wirkt in beide Richtungen. Ein hoher Erl\u00f6s hilft dem Berechtigten. Ein auff\u00e4llig niedriger Erl\u00f6s an eine nahestehende Person l\u00e4sst sich mit dem Nachweis angreifen, dass er dem tats\u00e4chlichen Wert nicht entsprach.<\/p><\/div>\n\n\n\n<h2 id=\"ein-konvolut-bilder-3-000-euro\" class=\"wp-block-heading\">\u201eEin Konvolut Bilder, 3.000 Euro&#8220;<\/h2>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-fbe10de\" data-block-id=\"fbe10de\"><p class=\"stk-block-text__text\">\u201eEin Picasso und ein Kunstdruck?&#8220; So hat ein Nutzer in einem juristischen Fachforum das Problem zusammengefasst. In dem Nachlassverzeichnis, das er vor sich hatte, stand unter anderem \u201eBild alt, Bild neu&#8220;.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-8367ec4\" data-block-id=\"8367ec4\"><p class=\"stk-block-text__text\">Sammelposten dieser Art erf\u00fcllen die Anforderungen in der Regel nicht. Das Verzeichnis muss geordnet und so konkret sein, dass sich die Gegenst\u00e4nde identifizieren und bewerten lassen. Gerichte haben bei Bildern Angaben zu Gr\u00f6\u00dfe, Rahmen, Alter, Material und Hersteller verlangt. Fehlt eine brauchbare Beschreibung, sind Fotos beizuf\u00fcgen. Dabei spielt es keine Rolle, ob ein Gegenstand tats\u00e4chlich wertlos ist. Der Erbe darf nicht selbst vorsortieren.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-28692a4\" data-block-id=\"28692a4\"><p class=\"stk-block-text__text\">Ein notarielles Verzeichnis soll mehr Sicherheit bieten als eine Liste des Erben. Daf\u00fcr muss der Notar den Nachlass selbst ermitteln. Er darf sich nicht darauf beschr\u00e4nken, die Angaben des Erben aufzuschreiben. Ein Oberlandesgericht hat gegen eine Erbin ein Zwangsgeld best\u00e4tigt und dabei drei Vers\u00e4umnisse ausdr\u00fccklich beanstandet:<\/p><\/div>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Das Haus wurde nicht besichtigt und die Einrichtung nicht erfasst.<\/li>\n\n\n\n<li>Zu Wertgegenst\u00e4nden und Fahrzeugen wurde vor Ort nicht ermittelt.<\/li>\n\n\n\n<li>Fr\u00fchere Versicherungspolicen wurden nicht ausreichend gekl\u00e4rt.<\/li>\n<\/ul>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-0e1c9ac\" data-block-id=\"0e1c9ac\"><p class=\"stk-block-text__text\">Der letzte Punkt ist f\u00fcr Kunstf\u00e4lle der wichtigste. Kunstversicherungen f\u00fchren Einzelpositionen mit Werten.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-0377083\" data-block-id=\"0377083\"><p class=\"stk-block-text__text\">Die Ermittlung hat aber eine harte Grenze. In die Privatwohnung des Erben kommt der Notar nicht. Sind die Bilder zwischen Todestag und Verzeichnisaufnahme bereits abgeh\u00e4ngt und mitgenommen worden, endet die Besichtigung an dessen Wohnungst\u00fcr.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-a3ba9ce\" data-block-id=\"a3ba9ce\"><p class=\"stk-block-text__text\">Eine zweite Grenze zieht die Rechtsprechung nach oben. Der Bundesgerichtshof hat entschieden, dass ein Notar nicht verpflichtet ist, ohne konkrete Anhaltspunkte in alle denkbaren Richtungen zu ermitteln. Blo\u00dfe Vermutungen gen\u00fcgen nicht. Praktisch hei\u00dft das: Ein pauschales \u201eich glaube, da war mehr&#8220; tr\u00e4gt nicht weit. Anders ist es bei konkreten Angaben. Sechs gro\u00dfformatige \u00d6lbilder im Wohnzimmer, eine bestehende Kunstversicherung oder eine Ausstellungsteilnahme sind genau die Anhaltspunkte, auf die es ankommt.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-af83972\" data-block-id=\"af83972\"><p class=\"stk-block-text__text\">Bleiben trotzdem L\u00fccken, f\u00fchrt der Weg bei einem notariellen Verzeichnis meist nicht \u00fcber eine Nachbesserung, sondern \u00fcber die eidesstattliche Versicherung. Damit ist die Best\u00e4tigung an Eides statt gemeint, dass die Auskunft nach bestem Wissen richtig und vollst\u00e4ndig ist. Die H\u00fcrde ist niedrig, es gen\u00fcgt bereits ein Verdacht der Unvollst\u00e4ndigkeit. Eine Erg\u00e4nzung des Verzeichnisses kommt nur ausnahmsweise in Betracht, etwa wenn ganze Bereiche fehlen. F\u00fcr solche F\u00e4lle gibt es die Pflichtteilserg\u00e4nzung, einen zus\u00e4tzlichen Anspruch, der Schenkungen nachtr\u00e4glich in die Rechnung holt (\u00a7 2325 BGB).<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-38d4d02\" data-block-id=\"38d4d02\"><p class=\"stk-block-text__text\">Ber\u00fccksichtigt werden Schenkungen aus den letzten zehn Jahren vor dem Tod, allerdings nicht durchgehend in voller H\u00f6he. Eine Schenkung aus dem letzten Jahr vor dem Tod z\u00e4hlt vollst\u00e4ndig. Mit jedem weiteren Jahr sinkt der Anteil um ein Zehntel, und was mehr als zehn Jahre zur\u00fcckliegt, bleibt au\u00dfer Betracht. Bei Schenkungen an den Ehegatten gilt das nicht. Dort beginnt die Frist erst mit der Aufl\u00f6sung der Ehe, sodass es beim Tod des Erblassers praktisch keine Zehnjahresgrenze gibt.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-ed093fc\" data-block-id=\"ed093fc\"><p class=\"stk-block-text__text\">An einer Stelle arbeitet die Regelung deutlich gegen den Berechtigten, und bei Kunst wirkt sich das besonders stark aus.<\/p><\/div>\n\n\n\n<h3 id=\"rechenbeispiel-warum-die-wertsteigerung-nicht-mitzahlt\" class=\"wp-block-heading\">Rechenbeispiel: Warum die Wertsteigerung nicht mitz\u00e4hlt<\/h3>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-358ba12\" data-block-id=\"358ba12\"><p class=\"stk-block-text__text\">Ein verwitweter Vater schenkt seiner \u00e4lteren Tochter ein \u00d6lgem\u00e4lde eines bekannten Nachkriegsk\u00fcnstlers. Damals ist es 200.000 Euro wert. Als der Vater Jahre sp\u00e4ter stirbt, liegt der Wert bei 900.000 Euro. Die j\u00fcngere Tochter ist enterbt.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-3ca0e18\" data-block-id=\"3ca0e18\"><p class=\"stk-block-text__text\">F\u00fcr die Berechnung werden zwei Werte verglichen, der Wert zur Zeit der Schenkung und der Wert am Todestag. Der alte Wert wird dabei um die Inflation bereinigt und liegt dann bei etwa 270.000 Euro. Angesetzt wird der niedrigere der beiden Werte, also 270.000 Euro und nicht 900.000 Euro. Die Wertsteigerung von rund 630.000 Euro bleibt im Ergebnis bei der beschenkten Tochter.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-da72f0f\" data-block-id=\"da72f0f\"><p class=\"stk-block-text__text\">Die Zahlen in diesem Beispiel sind frei gew\u00e4hlt und dienen nur der Veranschaulichung.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-639bfc8\" data-block-id=\"639bfc8\"><p class=\"stk-block-text__text\">Bei Immobilien f\u00e4llt dieser Effekt kaum auf. Bei Kunst ist er die Hauptsache, weil die Wertsteigerungen dort sehr gro\u00df ausfallen k\u00f6nnen.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-8e0aa24\" data-block-id=\"8e0aa24\"><p class=\"stk-block-text__text\">Wie viel von einer Schenkung am Ende \u00fcbrig bleibt, h\u00e4ngt au\u00dferdem an einer Vorfrage. Sie lautet, wann die Zehnjahresfrist \u00fcberhaupt zu laufen begonnen hat. Sie beginnt n\u00e4mlich erst, wenn der Erblasser den Gegenstand wirklich aus der Hand gegeben hat. F\u00fcr Grundst\u00fccke ist das gekl\u00e4rt. Beh\u00e4lt sich der Schenker den Nie\u00dfbrauch vor, also das Recht, das Grundst\u00fcck weiter in vollem Umfang zu nutzen, l\u00e4uft die Frist regelm\u00e4\u00dfig nicht an. Ein blo\u00dfes Wohnrecht reicht daf\u00fcr nur in Ausnahmef\u00e4llen. Ob dasselbe gilt, wenn ein verschenktes Bild weiter im Wohnzimmer des Erblassers h\u00e4ngt, ist bisher nicht entschieden. Gute Gr\u00fcnde sprechen daf\u00fcr, denn wirtschaftlich hat sich f\u00fcr den Erblasser nichts ge\u00e4ndert. Verl\u00e4sslich beurteilen l\u00e4sst sich das nur im Einzelfall.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-8bd560c\" data-block-id=\"8bd560c\"><p class=\"stk-block-text__text\">Auch eine Stiftung ist nach der Rechtsprechung kein sicherer Schutz. Der Bundesgerichtshof behandelt die Einbringung von Verm\u00f6gen in eine Stiftung als Schenkung, sodass sie \u00fcber den Erg\u00e4nzungsanspruch wieder einbezogen werden kann. Ab wann die Zehnjahresfrist dort l\u00e4uft, ist unter Fachleuten umstritten.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-29ca06c\" data-block-id=\"29ca06c\"><p class=\"stk-block-text__text\">Ein Punkt wirkt still und ist trotzdem der h\u00e4rteste. Ist im Nachlass nichts mehr vorhanden, kommt ein Anspruch unmittelbar gegen den Beschenkten in Betracht. F\u00fcr diesen Anspruch beginnt die Verj\u00e4hrungsfrist bereits mit dem Todestag, unabh\u00e4ngig davon, ob der Berechtigte von der Schenkung \u00fcberhaupt wei\u00df. Er kann also verj\u00e4hren, bevor jemand von ihm erf\u00e4hrt. Beim Anspruch gegen den Erben ist das anders. Dort gilt die \u00fcbliche Frist von drei Jahren ab dem Ende des Jahres, in dem der Berechtigte vom Erbfall und von seiner Enterbung erfahren hat. Bei einer Leihe geht das Eigentum nicht \u00fcber, der Erblasser bleibt Eigent\u00fcmer und kann das Werk zur\u00fcckverlangen. Ein Bild, das seit f\u00fcnfzehn Jahren in einem Museum h\u00e4ngt, geh\u00f6rt also weiterhin zum Nachlass und z\u00e4hlt grunds\u00e4tzlich in vollem Umfang mit. F\u00fcr Sammler ist die Gestaltung attraktiv, weil es im Erbschaftsteuerrecht weitreichende Befreiungen f\u00fcr Kunst gibt, die praktisch \u00fcber einen Vertrag mit einem Museum erreicht werden. Das ist keine Manipulation, sondern eine legitime Gestaltung. F\u00fcr Pflichtteilsberechtigte ist es trotzdem der wichtigste blinde Fleck. Wer nur nach dem fragt, was in der Wohnung hing, erf\u00e4hrt davon nichts. Ob eine als Dauerleihgabe bezeichnete \u00dcberlassung im Einzelfall doch eine Schenkung war, h\u00e4ngt vom Vertrag ab.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-fc9e3fb\" data-block-id=\"fc9e3fb\"><p class=\"stk-block-text__text\">Kunst in einer Gesellschaft. Geh\u00f6rt die Sammlung nicht dem Erblasser pers\u00f6nlich, sondern einer GmbH oder einer Familiengesellschaft, wird f\u00fcr den Pflichtteil der Gesellschaftsanteil bewertet und nicht das einzelne Bild. Darin liegt eine Falle. Anteile werden \u00fcblicherweise nach dem Ertrag bewertet, und eine Gesellschaft, die nur Bilder h\u00e4lt, erwirtschaftet keine Ertr\u00e4ge. Verm\u00f6gen, das dem Betrieb nicht dient, wird deshalb \u00fcblicherweise gesondert angesetzt. Eine Entscheidung, die das ausdr\u00fccklich f\u00fcr den Pflichtteil festh\u00e4lt, gibt es allerdings nicht. Das ist eine eigene Rechnung mit eigenen Fallstricken und im Einzelfall anwaltlich zu kl\u00e4ren.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-aac20c7\" data-block-id=\"aac20c7\"><p class=\"stk-block-text__text\">Kunst im Ausland. Ein Notar kann au\u00dferhalb seines Amtsbereichs nicht besichtigen, ein Bild in einem Schweizer Zolllager wird also faktisch nie in Augenschein genommen. Dazu kommt eine L\u00fccke bei den Unterlagen. Eine Genehmigung braucht die Ausfuhr von Kunst erst ab einem bestimmten Alter und einem hohen Wert. Darunter kann ein Werk die Grenze passieren, ohne dass eine Akte entsteht. Oberhalb dieser Grenzen gilt das Gegenteil. Dann entstehen Genehmigungsakten bei den Landesbeh\u00f6rden, und die werden bei der Suche oft \u00fcbersehen.<\/p><\/div>\n\n\n\n<h2 id=\"wenn-der-erbe-nicht-zahlen-kann-oder-nicht-will\" class=\"wp-block-heading\">Wenn der Erbe nicht zahlen kann oder nicht will<\/h2>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-ca7fa89\" data-block-id=\"ca7fa89\"><p class=\"stk-block-text__text\">Der Pflichtteil ist sofort f\u00e4llig. Ein Erbe, der nur Bilder geerbt hat und kein Geld, steht damit unter Druck. Er kann einen Zahlungsaufschub beantragen, wenn die sofortige Erf\u00fcllung wegen der Art der Nachlassgegenst\u00e4nde eine unbillige H\u00e4rte w\u00e4re. Das Gesetz denkt dabei aber vor allem an das Familienheim und an Verm\u00f6gen, das die wirtschaftliche Lebensgrundlage der Familie bildet. Eine Kunstsammlung ist typischerweise keines von beiden. Sie ist gerade das gut verwertbare Verm\u00f6gen.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-82236cf\" data-block-id=\"82236cf\"><p class=\"stk-block-text__text\">Warum es trotzdem oft z\u00e4h wird, erkl\u00e4rt ein Blick ins Steuerrecht. F\u00fcr Kunst gibt es weitreichende erbschaftsteuerliche Befreiungen. Sie entfallen aber r\u00fcckwirkend, wenn die Werke innerhalb von zehn Jahren nach dem Erwerb verkauft werden. Verkauft der Erbe also Bilder, um den Pflichtteil auszuzahlen, verliert er die Steuerbefreiung. Das macht das Verhalten der Gegenseite erkl\u00e4rbar und zeigt, warum so h\u00e4ufig \u00fcber einen Aufschub gesprochen wird.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-22bb7be\" data-block-id=\"22bb7be\"><p class=\"stk-block-text__text\">Umgekehrt gilt etwas, das oft anders dargestellt wird. Eine Steuerbefreiung mindert den Pflichtteil nicht. Sie betrifft ausschlie\u00dflich die Steuer, f\u00fcr den Pflichtteil kommt es allein auf den Wert zum Todestag an. Dasselbe gilt f\u00fcr die Freibetr\u00e4ge, die es f\u00fcr Hausrat und andere bewegliche Gegenst\u00e4nde gibt. Sie senken die Steuer, nicht den Anspruch.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-0b2c7a7\" data-block-id=\"0b2c7a7\"><p class=\"stk-block-text__text\">Bleibt der Erbe unt\u00e4tig, k\u00f6nnen Gerichte ein Zwangsgeld festsetzen, um ihn zur Vorlage des Verzeichnisses oder zur Wertermittlung anzuhalten. F\u00fcr ein notarielles Verzeichnis wird ihm allerdings eine angemessene Zeit zugestanden, \u00fcblicherweise einige Monate. Wer nicht unbegrenzt warten will, geht deshalb h\u00e4ufig den Weg \u00fcber eine Klage, die Auskunft und Zahlung in einem Verfahren verbindet. Im Nachlassverzeichnis gen\u00fcgt ein Sammelposten ebenso wenig wie bei Bildern. \u201eKonvolut Schmuck&#8220; sagt nicht mehr aus als \u201eKonvolut Bilder&#8220;. Auch die Auskunftsrechte sind dieselben, einschlie\u00dflich der Wertermittlung auf Kosten des Nachlasses.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-d2a0258\" data-block-id=\"d2a0258\"><p class=\"stk-block-text__text\">Drei Unterschiede sind f\u00fcr Betroffene wichtig.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-72472be\" data-block-id=\"72472be\"><p class=\"stk-block-text__text\">Schmuck hat mit dem Material eine belastbare Untergrenze. Gold und Steine haben zum Todestag einen feststellbaren Kurswert, unabh\u00e4ngig davon, wie der Markt eine bestimmte Form oder Marke gerade bewertet. Bei Kunst gibt es eine solche Untergrenze nicht. Ein Bild kann am Todestag bei null liegen, ein Ring aus Altgold nicht. Nach oben gilt allerdings dieselbe Vorsicht wie bei Kunst. Auch bei Schmuck ist der erzielbare Verkaufswert regelm\u00e4\u00dfig deutlich niedriger als die Summe in einer Versicherungspolice.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-b7a4505\" data-block-id=\"b7a4505\"><p class=\"stk-block-text__text\">Oldtimer sind zugelassen und damit registriert. Anders als bei einem Gem\u00e4lde existiert eine amtliche Spur, an der sich Existenz und Halter nachvollziehen lassen. Hinzu kommt, dass Gerichte es ausdr\u00fccklich beanstandet haben, wenn ein Notar Wertgegenst\u00e4nde und Fahrzeuge nicht vor Ort ermittelt hat. Wer wei\u00df, dass in der Garage etwas stand, benennt damit einen brauchbaren Anhaltspunkt.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-c95a503\" data-block-id=\"c95a503\"><p class=\"stk-block-text__text\">Sammlungen aus M\u00fcnzen, Briefmarken oder \u00e4hnlichen Objekten haben ein eigenes Problem. Der Katalogwert einer Sammlung ist nicht ihr Verkaufswert. Bei sehr gro\u00dfen Best\u00e4nden kommt hinzu, dass die Menge selbst den erzielbaren Preis dr\u00fcckt, weil der Markt sie nicht auf einmal aufnimmt. Belegt ist dieser Effekt allerdings vor allem aus dem Ausland. F\u00fcr das deutsche Pflichtteilsrecht ist er eine Beobachtung aus dem Markt und keine gesicherte Rechtslage, weshalb sich daraus kein pauschaler Abschlag ableiten l\u00e4sst.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-11e1bdf\" data-block-id=\"11e1bdf\"><p class=\"stk-block-text__text\">Bei den Kosten gibt es immerhin Anhaltspunkte. F\u00fcr private Bewertungsauftr\u00e4ge sind nach Angabe der Industrie- und Handelskammern Stundens\u00e4tze zwischen 50 und 150 Euro \u00fcblich. F\u00fcr Gutachten, die ein Gericht in Auftrag gibt, sind die S\u00e4tze gesetzlich festgelegt und bewegen sich in einer \u00e4hnlichen Gr\u00f6\u00dfenordnung. Honorare, die sich nach einem Prozentsatz des gesch\u00e4tzten Wertes richten, sind f\u00fcr Deutschland dagegen nicht belegt.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-5ee104f\" data-block-id=\"5ee104f\"><p class=\"stk-block-text__text\">Wer eine Bewertung braucht, hat vier Wege. \u00d6ffentlich bestellte und vereidigte Sachverst\u00e4ndige sind \u00fcber die Sachverst\u00e4ndigensuche der Industrie- und Handelskammern zu finden. Der Bundesverband der Sachverst\u00e4ndigen hat einen eigenen Fachbereich f\u00fcr Kunst, Antiquit\u00e4ten und Juwelen. Auktionsh\u00e4user sch\u00e4tzen h\u00e4ufig kostenlos ein, haben dabei aber ein eigenes Interesse an der Einlieferung. Dazu kommen freie Kunstsachverst\u00e4ndige.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-5b0999d\" data-block-id=\"5b0999d\"><p class=\"stk-block-text__text\">Was es dagegen nicht gibt, ist eine amtliche Stelle, die f\u00fcr Kunst oder f\u00fcr andere Wertgegenst\u00e4nde einen Wert feststellt. Das unterscheidet diesen Bereich von der Immobilienbewertung, wo Gutachteraussch\u00fcsse und amtliche Kaufpreissammlungen zur Verf\u00fcgung stehen.<\/p><\/div>\n\n\n\n<h2 id=\"typische-konfliktpunkte-und-fehler\" class=\"wp-block-heading\">Typische Konfliktpunkte und Fehler<\/h2>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-948fdfd\" data-block-id=\"948fdfd\"><p class=\"stk-block-text__text\">Den Versicherungswert f\u00fcr den Nachlasswert halten. Die Zahl in der Police liegt regelm\u00e4\u00dfig deutlich \u00fcber dem Betrag, der sich bei einem Verkauf erzielen l\u00e4sst. Wer damit rechnet, baut eine Erwartung auf, die sich sp\u00e4ter nicht halten l\u00e4sst.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-c3c359f\" data-block-id=\"c3c359f\"><p class=\"stk-block-text__text\">Einen Sammelposten hinnehmen. \u201eEin Konvolut Bilder, 3.000 Euro&#8220; ist kein Endpunkt. Gerichte haben verlangt, dass einzelne Gegenst\u00e4nde mit ihren wertbildenden Merkmalen beschrieben werden, bei Bildern also mit Gr\u00f6\u00dfe, Rahmen, Alter und Material.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-095673b\" data-block-id=\"095673b\"><p class=\"stk-block-text__text\">Vermutungen statt Anhaltspunkte \u00e4u\u00dfern. \u201eDa muss noch mehr gewesen sein&#8220; f\u00fchrt nach der Rechtsprechung nicht weiter. Eine konkrete Angabe schon, etwa sechs gro\u00dfe \u00d6lbilder im Wohnzimmer oder eine bestehende Kunstversicherung.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-d36612e\" data-block-id=\"d36612e\"><p class=\"stk-block-text__text\">Nur an die Wohnung denken. Dauerleihgaben an Museen, Werke bei Restauratoren und Bilder im Ausland tauchen dort nicht auf. Zum Nachlass geh\u00f6ren sie trotzdem, und ohne einen Hinweis darauf sucht auch ein Notar nicht danach.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-28ddf6e\" data-block-id=\"28ddf6e\"><p class=\"stk-block-text__text\">Ein verkauftes Werk f\u00fcr erledigt halten. Auch wenn der Erbe die Sammlung l\u00e4ngst ver\u00e4u\u00dfert hat, entf\u00e4llt der Anspruch auf eine Wertermittlung nicht. Der erzielte Preis ist ein Anhaltspunkt, aber kein Schlusspunkt.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-72e8fc0\" data-block-id=\"72e8fc0\"><p class=\"stk-block-text__text\">Auf ein Gutachten nach eigenen Vorstellungen hoffen. Der Erbe sucht den Sachverst\u00e4ndigen aus, und ein Anspruch auf ein Ergebnis in bestimmter H\u00f6he besteht nicht. Auch ein drittes Gutachten l\u00e4sst sich in der Regel nicht verlangen.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-2711bdb\" data-block-id=\"2711bdb\"><p class=\"stk-block-text__text\">Wertangaben aus dem Testament f\u00fcr bindend halten. Eine Wertbestimmung des Erblassers ist f\u00fcr die Berechnung ausdr\u00fccklich nicht ma\u00dfgebend, egal wie eindeutig sie formuliert ist. Dasselbe gilt f\u00fcr den Preis, den er selbst einmal bezahlt hat.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-1cc5623\" data-block-id=\"1cc5623\"><p class=\"stk-block-text__text\">Bei einer verschenkten Sammlung abwarten. Beim Anspruch gegen einen Beschenkten l\u00e4uft die Frist bereits ab dem Todestag, auch wenn von der Schenkung noch niemand wei\u00df. Der Anspruch kann verj\u00e4hren, bevor er \u00fcberhaupt entdeckt wird.<\/p><\/div>\n\n\n\n<h2 id=\"haufige-fragen\" class=\"wp-block-heading\">H\u00e4ufige Fragen<\/h2>\n\n\n\n<h3 id=\"der-erbe-sagt-die-bilder-seien-wertlos-was-kann-ich-tun\" class=\"wp-block-heading\">Der Erbe sagt, die Bilder seien wertlos. Was kann ich tun?<\/h3>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-d5dcbc2\" data-block-id=\"d5dcbc2\"><p class=\"stk-block-text__text\">In dieser Lage sieht das Gesetz mehrere M\u00f6glichkeiten vor. Die Werte lassen sich durch einen unparteiischen Sachverst\u00e4ndigen ermitteln, und die Kosten fallen dabei grunds\u00e4tzlich dem Nachlass zur Last. Au\u00dferdem m\u00fcssen die Gegenst\u00e4nde im Verzeichnis so beschrieben sein, dass eine Bewertung \u00fcberhaupt m\u00f6glich ist, bei Bildern also mit Angaben zu Gr\u00f6\u00dfe, Rahmen, Alter und Material. Bleibt der Verdacht, dass etwas fehlt, kommt eine eidesstattliche Versicherung \u00fcber die Richtigkeit der Auskunft in Betracht. Ob und in welcher Reihenfolge diese Schritte sinnvoll sind, sollte anwaltlich gepr\u00fcft werden.<\/p><\/div>\n\n\n\n<h3 id=\"zahlt-ein-gemalde-zum-hausrat\" class=\"wp-block-heading\">Z\u00e4hlt ein Gem\u00e4lde zum Hausrat?<\/h3>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-08ba86c\" data-block-id=\"08ba86c\"><p class=\"stk-block-text__text\">Das ist eine Frage des Einzelfalls. Sie hat Gewicht, weil der \u00fcberlebende Ehegatte Haushaltsgegenst\u00e4nde unter bestimmten Voraussetzungen aus der Berechnung heraushalten kann. Gemeint sind damit Gegenst\u00e4nde, die dem Haushalt dienen, nicht Anlage- oder Sammlungsobjekte. Bei einer Sammlung spricht deshalb viel dagegen, sie als Hausrat zu behandeln. Eine klare Entscheidung zu dieser Abgrenzung gibt es f\u00fcr den Pflichtteil allerdings nicht.<\/p><\/div>\n\n\n\n<h3 id=\"wer-bezahlt-das-gutachten-fur-die-kunstsammlung\" class=\"wp-block-heading\">Wer bezahlt das Gutachten f\u00fcr die Kunstsammlung?<\/h3>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-c708ea0\" data-block-id=\"c708ea0\"><p class=\"stk-block-text__text\">Grunds\u00e4tzlich der Nachlass. Die Kosten der Wertermittlung geh\u00f6ren zu den Kosten, die aus dem Nachlass zu tragen sind, und nicht zu den privaten Kosten des Pflichtteilsberechtigten. Davon kann es bei einem sehr kleinen Nachlass eine Ausnahme geben, wenn die Kosten au\u00dfer Verh\u00e4ltnis stehen. Die Voraussetzungen daf\u00fcr muss allerdings der Erbe nachweisen. Wer selbst ein zus\u00e4tzliches Gutachten beauftragt, um eine eigene Zahl vorlegen zu k\u00f6nnen, tr\u00e4gt diese Kosten dagegen selbst.<\/p><\/div>\n\n\n\n<h3 id=\"der-erbe-hat-die-sammlung-schon-verkauft-habe-ich-noch-anspruche\" class=\"wp-block-heading\">Der Erbe hat die Sammlung schon verkauft. Der Anspruch auf eine Wertermittlung entf\u00e4llt durch einen Verkauf nicht. Der Bundesgerichtshof hat das damit begr\u00fcndet, dass sich sonst nicht \u00fcberpr\u00fcfen lie\u00dfe, ob unter Wert verkauft wurde. Der erzielte Preis ist dabei ein wesentlicher Anhaltspunkt f\u00fcr den Wert am Todestag, insbesondere wenn der Verkauf zeitnah stattgefunden hat. Dieser Anhaltspunkt ist aber widerlegbar. Wer darlegen kann, dass der Erl\u00f6s nicht dem tats\u00e4chlichen Wert entsprach, etwa bei einem Verkauf an eine nahestehende Person, kann eine Sch\u00e4tzung erreichen.<\/p><\/div>\n\n\n\n<h3 id=\"muss-ich-mich-mit-dem-gutachten-des-erben-zufriedengeben\" class=\"wp-block-heading\">Muss ich mich mit dem Gutachten des Erben zufriedengeben?<\/h3>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-199c4e0\" data-block-id=\"199c4e0\"><p class=\"stk-block-text__text\">F\u00fcr die Frage, ob die Auskunftspflicht erf\u00fcllt ist, kann ein solches Gutachten gen\u00fcgen. Bei Kunst sind die Anforderungen nach der Rechtsprechung geringer als bei anderen Nachlassgegenst\u00e4nden, und auch eine Einsch\u00e4tzung eines renommierten Auktionshauses kann ausreichen. Ein zweites Gutachten auf Kosten des Nachlasses gibt es in der Regel nicht. F\u00fcr den Streit \u00fcber die Zahlung sagt das Gutachten dagegen nichts Endg\u00fcltiges. Dort wird der Wert erneut gepr\u00fcft, und dort l\u00e4sst sich auch eine abweichende Bewertung einbringen.<\/p><\/div>\n\n\n\n<h3 id=\"mein-vater-hat-seine-sammlung-vor-jahren-verschenkt-bekomme-ich-davon-noch-etwas\" class=\"wp-block-heading\">Mein Vater hat seine Sammlung vor Jahren verschenkt. Bekomme ich davon noch etwas?<\/h3>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-5115f01\" data-block-id=\"5115f01\"><p class=\"stk-block-text__text\">M\u00f6glich ist das innerhalb von zehn Jahren vor dem Tod, wobei die Schenkung mit jedem Jahr weniger ber\u00fccksichtigt wird. Angesetzt wird der niedrigere von zwei Werten, also entweder der um die Inflation bereinigte Wert bei der Schenkung oder der Wert am Todestag. Wichtig ist der Fristbeginn. Die Frist l\u00e4uft erst, wenn der Erblasser den Gegenstand wirklich aus der Hand gegeben hat. Und gegen einen Beschenkten gilt eine eigene Frist, die schon mit dem Todestag beginnt.<\/p><\/div>\n\n\n\n<h2 id=\"unterstutzung-wenn-es-schwierig-wird\" class=\"wp-block-heading\">Unterst\u00fctzung, wenn es schwierig wird<\/h2>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-7765e9f\" data-block-id=\"7765e9f\"><p class=\"stk-block-text__text\">Kunstf\u00e4lle sind aufwendiger als andere Pflichtteilsf\u00e4lle. Gutachten kosten Geld, bevor irgendetwas entschieden ist. Der Nachlass ist oft nicht liquide, weil der Wert in Gegenst\u00e4nden steckt. Der Erbe kann h\u00e4ufig nur zahlen, wenn er verkauft, und will das aus steuerlichen Gr\u00fcnden gerade nicht. \u00dcber den Wert wird deshalb lange gestritten, teilweise \u00fcber mehrere Instanzen.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-c1f7243\" data-block-id=\"c1f7243\"><p class=\"stk-block-text__text\">In dieser Lage gibt es f\u00fcr Betroffene zwei grunds\u00e4tzliche Wege. Der eine ist die Durchsetzung mit einer Finanzierung. Dabei werden die Kosten des Verfahrens getragen, und eine Beteiligung f\u00e4llt nur im Erfolgsfall an. Der andere ist der Verkauf des Anspruchs. Dabei flie\u00dft kurzfristig ein fester Betrag, der unter dem vollen Anspruchswert liegt, weil der K\u00e4ufer Risiko und Zeit \u00fcbernimmt.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-c19c6f0\" data-block-id=\"c19c6f0\"><p class=\"stk-block-text__text\">Welcher Weg passt, h\u00e4ngt davon ab, wie belastbar die Angaben zum Nachlass sind, wie weit die Kl\u00e4rung mit den Erben gediehen ist und wie viel Zeit jemand investieren m\u00f6chte.
