Er verpflichtet niemanden, er h\u00e4lt keine Frist an, und er verschafft Ihnen auch kein Recht auf Auskunft \u00fcber den Nachlass. Das liegt am Aufbau des Schweizer Erbrechts. Der Pflichtteil ist hier im Regelfall keine Geldforderung gegen die Erben, sondern ein gek\u00fcrzter Erbteil. Wer in einem Testament \u00fcbergangen wurde, hat deshalb zun\u00e4chst gar keinen Anspruch, den er beziffern k\u00f6nnte. Er muss zuerst vor Gericht seine Stellung als Erbe erstreiten, und daf\u00fcr bleibt ihm ein Jahr.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-54ceffa\" data-block-id=\"54ceffa\"><p class=\"stk-block-text__text\">Ein Hinweis vorweg. Eltern haben seit dem 1. Januar 2023 keinen Pflichtteil mehr, Geschwister und Konkubinatspartner haben keinen (Art. 470 f. ZGB).<\/li>\n\n\n\n<li>Der Pflichtteil betr\u00e4gt die H\u00e4lfte des gesetzlichen Erbanspruchs (Art. 471 ZGB). F\u00fcr Nachkommen waren es bis Ende 2022 noch drei Viertel.<\/li>\n\n\n\n<li>Er ist im Normalfall kein Zahlungsanspruch gegen die Erben, sondern ein Anteil am Nachlass. Wer \u00fcbergangen wurde, muss klagen, um \u00fcberhaupt in die Erbenstellung zu gelangen.<\/li>\n\n\n\n<li>Daf\u00fcr bleibt ein Jahr ab Kenntnis von der Verletzung, \u00e4usserstenfalls zehn Jahre (Art. 533 ZGB). Die Frist wahrt nur, wer zum Gericht geht. Verhandlungen und Anwaltsschreiben halten sie nicht an.<\/li>\n\n\n\n<li>Auskunft \u00fcber den Nachlass bekommen Sie nicht auf blosse Anfrage. Wer die Jahresfrist verstreichen l\u00e4sst, verliert nach der Rechtsprechung sogar sein erbrechtliches Auskunftsrecht.<\/li>\n\n\n\n<li>Wer die Erbenstellung erlangt, haftet daf\u00fcr mit seinem Privatverm\u00f6gen f\u00fcr die Schulden des Erblassers (Art. 603 ZGB).<\/li>\n<\/ul>\n\n\n\n<h2 id=\"gilt-fur-ihren-fall-schweizer-recht\" class=\"wp-block-heading\">Gilt f\u00fcr Ihren Fall Schweizer Recht?<\/h2>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-dee183b\" data-block-id=\"dee183b\"><p class=\"stk-block-text__text\">Massgeblich ist nicht die Staatsangeh\u00f6rigkeit, sondern der letzte Wohnsitz der verstorbenen Person. Wer zuletzt in der Schweiz gelebt hat, hinterl\u00e4sst in der Regel einen Nachlass, f\u00fcr den schweizerische Gerichte zust\u00e4ndig sind und auf den schweizerisches Recht angewendet wird (Art. 86 und 90 IPRG). Das gilt auch f\u00fcr deutsche Staatsangeh\u00f6rige, die in der Schweiz gewohnt haben, und aus deutscher Sicht f\u00fchrt die Europ\u00e4ische Erbrechtsverordnung beim gew\u00f6hnlichen Aufenthalt in der Schweiz zum selben Ergebnis.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-1f62500\" data-block-id=\"1f62500\"><p class=\"stk-block-text__text\">Abweichen kann davon nur, wer zu Lebzeiten selbst etwas anderes verf\u00fcgt hat. Jede Person darf ihren Nachlass durch Testament oder Erbvertrag dem Recht eines ihrer Heimatstaaten unterstellen (Art. 91 IPRG), unter bestimmten Voraussetzungen auch der Zust\u00e4ndigkeit dieses Staates (Art. 88b IPRG). Eine Grenze steht allerdings gleich daneben in Art. 91 Abs. 1 IPRG, und sie wird h\u00e4ufig \u00fcbersehen. Ein Schweizer kann den Schweizer Pflichtteil nicht ausschalten, auch nicht als Doppelb\u00fcrger und auch nicht, indem er im Testament deutsches Recht w\u00e4hlt. War der Erblasser dagegen ausschliesslich Ausl\u00e4nder, gilt nach einer solchen Wahl das Pflichtteilsrecht des gew\u00e4hlten Staates, bei deutschem Recht also der deutsche Pflichtteil.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-9b2fc73\" data-block-id=\"9b2fc73\"><p class=\"stk-block-text__text\">Der Blick ins Testament lohnt sich deshalb nicht nur wegen des Inhalts. Erbanspruchs, er ist also ein gek\u00fcrzter Erbteil (Art. 471 ZGB). Wer ihn hat, soll nach der Vorstellung des Gesetzes Erbe sein und nicht Gl\u00e4ubiger. Genau daraus entsteht das Problem f\u00fcr alle, die im Testament \u00fcbergangen wurden. Juristen nennen sie virtuelle Erben. Sie stehen in keinem Papier, geh\u00f6ren nicht zur Erbengemeinschaft und haben auch keinen Betrag, den sie in Rechnung stellen k\u00f6nnten.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-2f3602c\" data-block-id=\"2f3602c\"><p class=\"stk-block-text__text\">Um das zu \u00e4ndern, gibt es zwei Klagen, die in der Praxis oft zusammen erhoben werden. Mit der Herabsetzungsklage verlangen Sie, dass die Verf\u00fcgungen des Erblassers so weit zur\u00fcckgeschnitten werden, bis Ihr Pflichtteil wiederhergestellt ist (Art. 522 ZGB). Mit der Ung\u00fcltigkeitsklage greifen Sie das Testament als solches an, etwa weil die Form nicht stimmt, weil der Erblasser nicht mehr urteilsf\u00e4hig war oder weil er get\u00e4uscht oder unter Druck gesetzt wurde (Art. 519 ff. ZGB). Der Unterschied im Ergebnis ist erheblich. Die Herabsetzung verschafft den Pflichtteil, die Ung\u00fcltigkeit kann bis zum vollen gesetzlichen Erbteil f\u00fchren, sofern nicht ein \u00e4lteres Testament an die Stelle des angefochtenen tritt. Erst mit einem erfolgreichen Urteil erlangt ein \u00dcbergangener die Erbenstellung, wie das Bundesgericht ausdr\u00fccklich festgehalten hat (BGE 143 III 369).<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-bd21e90\" data-block-id=\"bd21e90\"><p class=\"stk-block-text__text\">Damit ist er allerdings noch nicht am Geld. Ein Erbteil ist kein Guthaben. Sie geh\u00f6ren dann zur Erbengemeinschaft, und dort geh\u00f6rt alles allen gemeinsam. Solange nicht geteilt ist, kann niemand allein ein Konto aufl\u00f6sen oder ein Haus verkaufen, jede Auszahlung braucht die Zustimmung der anderen (Art. 602 ZGB). Geld sehen Sie erst bei der Teilung. Verlangen kann sie jeder Erbe jederzeit, notfalls muss er auch sie einklagen (Art. 604 ZGB). In der Praxis werden Herabsetzung und Teilung deshalb h\u00e4ufig in einem Verfahren zusammengefasst.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-171dea3\" data-block-id=\"171dea3\"><p class=\"stk-block-text__text\">Eine Variante f\u00e4llt aus diesem Muster heraus. Nach heute \u00fcberwiegender Auffassung darf der Erblasser den Pflichtteil auch als Verm\u00e4chtnis zuwenden und die Erbenstellung damit vorenthalten. Das Bundesgericht hat die Frage bisher nicht ausdr\u00fccklich entschieden. Wer so bedacht wurde, hat tats\u00e4chlich einen Geldanspruch gegen die belasteten Erben, und der verj\u00e4hrt erst nach zehn Jahren (Art. 562 und 601 ZGB). Bleibt das Verm\u00e4chtnis wertm\u00e4ssig hinter dem Pflichtteil zur\u00fcck, l\u00e4uft f\u00fcr die Differenz aber wieder die Jahresfrist. Belasten darf der Erblasser den Pflichtteil dabei nicht, eine Nacherbeneinsetzung ist in seinem Umfang ung\u00fcltig (Art. 531 ZGB). Kl\u00e4ren Sie deshalb zuerst, ob das Testament Sie \u00fcbergeht, ausdr\u00fccklich enterbt oder mit einem Verm\u00e4chtnis bedenkt.<\/p><\/div>\n\n\n\n<h2 id=\"wer-in-der-schweiz-einen-pflichtteil-hat\" class=\"wp-block-heading\">Wer in der Schweiz einen Pflichtteil hat<\/h2>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-8ce3f40\" data-block-id=\"8ce3f40\"><p class=\"stk-block-text__text\">Gesch\u00fctzt sind die Nachkommen, also Kinder und an ihrer Stelle deren Kinder, sowie der \u00fcberlebende Ehegatte und der eingetragene Partner (Art. 470 Abs. 1 ZGB). Weiter reicht der Kreis nicht.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-f3fe5bd\" data-block-id=\"f3fe5bd\"><p class=\"stk-block-text__text\">Die Eltern der verstorbenen Person waren bis Ende 2022 ebenfalls pflichtteilsgesch\u00fctzt, seit dem 1. Januar 2023 sind sie es nicht mehr. Sie bleiben gesetzliche Erben und erben ohne Testament ganz normal, aber gegen ein Testament, das sie \u00fcbergeht, steht ihnen keine Herabsetzungsklage mehr zu. Ein formung\u00fcltiges oder in Urteilsunf\u00e4higkeit errichtetes Testament k\u00f6nnen sie als gesetzliche Erben weiterhin mit der Ung\u00fcltigkeitsklage angreifen. Geschwister, Grosseltern, Nichten und Neffen haben keinen Pflichtteil.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-51b24d5\" data-block-id=\"51b24d5\"><p class=\"stk-block-text__text\">Unverheiratete Paare trifft das hart. Der \u00fcberlebende Konkubinatspartner hat in der Schweiz weder ein gesetzliches Erbrecht noch einen Pflichtteil, und f\u00fcr Stiefkinder gilt dasselbe. Beide erhalten nur, was ihnen ausdr\u00fccklich zugewendet wurde. Wer weder Nachkommen noch einen Ehegatten oder eingetragenen Partner hinterl\u00e4sst, darf \u00fcber sein ganzes Verm\u00f6gen frei verf\u00fcgen (Art. 470 Abs. 2 ZGB).<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-58de089\" data-block-id=\"58de089\"><p class=\"stk-block-text__text\">Eine Sonderregel betrifft die zerbrochene Ehe. War beim Tod des Erblassers ein Scheidungsverfahren im Gang, verliert der \u00fcberlebende Ehegatte seinen Pflichtteilsanspruch, wenn das Verfahren auf gemeinsames Begehren eingeleitet oder fortgesetzt wurde oder wenn die Ehegatten mindestens zwei Jahre getrennt gelebt haben (Art. 472 ZGB). Ohne laufendes Verfahren \u00e4ndert auch eine lange Trennung nichts. Greift die Regel, werden die Pflichtteile so berechnet, wie wenn der Erblasser nicht verheiratet gewesen w\u00e4re, was den Anteil der Kinder entsprechend vergr\u00f6ssert.<\/p><\/div>\n\n\n\n<h2 id=\"wie-hoch-der-pflichtteil-ausfallt\" class=\"wp-block-heading\">Wie hoch der Pflichtteil ausf\u00e4llt<\/h2>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-c23ee58\" data-block-id=\"c23ee58\"><p class=\"stk-block-text__text\">Rechnen Sie zuerst aus, was Ihnen ohne Testament nach der gesetzlichen Erbfolge zugestanden h\u00e4tte, und halbieren Sie das. Das Ergebnis ist Ihr Pflichtteil (Art. 471 ZGB).<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-c4812c3\" data-block-id=\"c4812c3\"><p class=\"stk-block-text__text\">Die gesetzlichen Erbteile ergeben sich aus der Familienkonstellation. Neben Nachkommen erh\u00e4lt der \u00fcberlebende Ehegatte die H\u00e4lfte der Erbschaft, neben Eltern und Geschwistern des Verstorbenen drei Viertel, und sind auch die nicht vorhanden, die ganze Erbschaft (Art. 462 ZGB). Die Kinder teilen zu gleichen Teilen, was daneben \u00fcbrig bleibt (Art. 457 ZGB).<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-ce3e57b\" data-block-id=\"ce3e57b\"><p class=\"stk-block-text__text\">Ein Mann stirbt und hinterl\u00e4sst seine Frau und zwei Kinder. Nachdem das Verm\u00f6gen der Ehe aufgeteilt ist, dazu gleich mehr, bleibt ein Nachlass von 600&#8217;000 Franken. Gesetzlich st\u00fcnde der Witwe die H\u00e4lfte zu, also 300&#8217;000 Franken, den beiden Kindern je ein Viertel, also je 150&#8217;000 Franken. Die Pflichtteile betragen die H\u00e4lfte davon, mithin 150&#8217;000 Franken f\u00fcr die Witwe und je 75&#8217;000 Franken f\u00fcr die Kinder. \u00dcber die restlichen 300&#8217;000 Franken konnte der Verstorbene frei verf\u00fcgen.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-d417a64\" data-block-id=\"d417a64\"><p class=\"stk-block-text__text\">Bis Ende 2022 sah dieselbe Rechnung anders aus, weil Nachkommen damals drei Viertel ihres gesetzlichen Erbanspruchs als Pflichtteil beanspruchen konnten. Massgeblich ist der Todestag. F\u00fcr alle Erbf\u00e4lle ab dem 1. und zwar meist, weil niemand sie ernst genommen hat.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-808c47f\" data-block-id=\"808c47f\"><p class=\"stk-block-text__text\">Die Herabsetzungsklage muss innert eines Jahres erhoben werden, gerechnet ab dem Zeitpunkt, in dem Sie von der Verletzung Ihrer Rechte erfahren haben. Unabh\u00e4ngig davon ist nach zehn Jahren Schluss, bei Testamenten ab deren Er\u00f6ffnung, bei Schenkungen ab dem Tod (Art. 533 ZGB). F\u00fcr die Ung\u00fcltigkeitsklage gilt eine eigene Jahresfrist ab Kenntnis von der Verf\u00fcgung und vom Ung\u00fcltigkeitsgrund, ebenfalls mit zehn Jahren als \u00e4usserer Grenze. Gegen\u00fcber jemandem, der b\u00f6sgl\u00e4ubig bedacht wurde, verl\u00e4ngert sich diese \u00e4ussere Grenze bei Urteilsunf\u00e4higkeit, Rechtswidrigkeit oder Unsittlichkeit auf dreissig Jahre (Art. 521 ZGB).<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-7e15da0\" data-block-id=\"7e15da0\"><p class=\"stk-block-text__text\">Das Gesetz nennt die Herabsetzungsfrist Verj\u00e4hrung, das Bundesgericht behandelt sie als Verwirkungsfrist (BGE 138 III 354). Der Unterschied ist erheblich. Eine Verwirkungsfrist beachtet das Gericht von sich aus, und sie l\u00e4sst sich weder unterbrechen noch verl\u00e4ngern. Weder ein Mahnschreiben noch laufende Vergleichsgespr\u00e4che halten sie an, und die Bitte eines Erben um Geduld erst recht nicht. Die Frist wahrt nur, wer zum Gericht geht, wobei bereits die Einreichung des Schlichtungsgesuchs gen\u00fcgt (Art. 62 Abs. 1 und Art. 64 Abs. 2 ZPO). Deshalb wird in der Praxis h\u00e4ufig ein Schlichtungsgesuch eingereicht, bevor die Zahlen \u00fcberhaupt feststehen. Nach der Schlichtung bleiben noch drei Monate, um beim Gericht Klage einzureichen (Art. 209 ZPO).<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-2d8efe0\" data-block-id=\"2d8efe0\"><p class=\"stk-block-text__text\">Wann die Uhr zu laufen beginnt, ist damit die wichtigste Frage im ganzen Fall. Sie startet nicht am Todestag, sondern mit Ihrer Kenntnis. Wenn Sie im Testament schlicht nicht vorkommen, ergibt sich die Verletzung allerdings schon aus dem Testament selbst. Praktisch l\u00e4uft die Frist dann ab dem Tag, an dem Ihnen die Abschrift zugestellt wurde. Sp\u00e4ter beginnen kann sie vor allem gegen\u00fcber Personen, die zu Lebzeiten beschenkt wurden. Das Bundesgericht hat im August 2025 entschieden, dass die Jahresfrist gegen\u00fcber jedem einzelnen Empf\u00e4nger einer Zuwendung gesondert l\u00e4uft und erst beginnt, wenn dessen Identit\u00e4t bekannt ist (Urteil 5A_347\/2024, zur amtlichen Publikation bestimmt). Wenn Sie erst sp\u00e4t erfahren, dass kurz vor dem Tod eine grosse Summe an eine bestimmte Person geflossen ist, stehen Sie deshalb nicht zwingend zu sp\u00e4t da.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-e5d448a\" data-block-id=\"e5d448a\"><p class=\"stk-block-text__text\">Eine zweite Erleichterung hilft nur einem Teil der Betroffenen. Wer selbst schon etwas in H\u00e4nden h\u00e4lt, kann sich zeitlich unbegrenzt wehren, sobald die Gegenseite etwas von ihm herausverlangt (Art. 521 Abs. 3 und Art. 533 Abs. 3 ZGB). Und wer im Testament als Erbe eingesetzt ist und ausschlagen m\u00f6chte, hat daf\u00fcr drei Monate Zeit (Art. 567 ZGB).<\/p><\/div>\n\n\n\n<h2 id=\"was-sie-erfahren-konnen-bevor-sie-handeln-mussen\" class=\"wp-block-heading\">Was Sie erfahren k\u00f6nnen, bevor Sie handeln m\u00fcssen<\/h2>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-afebc83\" data-block-id=\"afebc83\"><p class=\"stk-block-text__text\">Ein amtliches Nachlassverzeichnis, das Ihnen jemand auf Verlangen und auf Kosten des Nachlasses erstellt, kennt das Schweizer Recht nicht. Das Gesetz verpflichtet stattdessen die Miterben, einander bei der Teilung genauen Aufschluss zu geben und alles mitzuteilen, was f\u00fcr eine gerechte Verteilung von Bedeutung ist (Art. 607 Abs. 3 und Art. 610 Abs. 2 ZGB). Auch Banken lassen sich in die Pflicht nehmen, weil das Auskunftsrecht des Verstorbenen gegen\u00fcber seiner Bank auf die Erben \u00fcbergeht (Art. 560 ZGB).<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-1d51dfe\" data-block-id=\"1d51dfe\"><p class=\"stk-block-text__text\">Ein \u00dcbergangener hat solche Rechte, aber nur, solange er klagt. Das Bundesgericht hat entschieden, dass ein vollst\u00e4ndig vom Erbgang ausgeschlossener Pflichtteilsberechtigter die Verf\u00fcgung innert eines Jahres anfechten muss, um seine Erbenstellung und sein erbrechtliches Auskunftsrecht nicht zu verlieren (BGE 138 III 354). Lassen Sie die Frist verstreichen, verlieren Sie also beides zugleich. Das ist der eigentliche Grund, die Jahresfrist auch dann zu wahren, wenn Sie noch gar nicht wissen, um wie viel es geht.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-96af15c\" data-block-id=\"96af15c\"><p class=\"stk-block-text__text\">Ein er\u00f6ffnetes Testament wird allen an der Erbschaft Beteiligten in Abschrift zugestellt, soweit es sie betrifft, und zwar auf Kosten der Erbschaft (Art. 558 ZGB). Dazu z\u00e4hlen nach der Praxis auch \u00fcbergangene gesetzliche Erben. Wenn Sie nichts erhalten haben, obwohl Sie als Kind oder Ehegatte erkennbar beteiligt sind, kommen Sie \u00fcber die f\u00fcr die Er\u00f6ffnung zust\u00e4ndige Beh\u00f6rde am letzten Wohnsitz weiter.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-ee77ea4\" data-block-id=\"ee77ea4\"><p class=\"stk-block-text__text\">Die Erbenbescheinigung ist der amtliche Ausweis dar\u00fcber, wer erben soll. Ohne sie geben Banken kein Geld heraus und das Grundbuchamt schreibt kein Haus um. Wenn Sie als gesetzlicher Erbe \u00fcbergangen wurden, etwa als enterbtes Kind, k\u00f6nnen Sie bei der Beh\u00f6rde ausdr\u00fccklich bestreiten, dass die im Testament Eingesetzten berechtigt sind (Art. 559 ZGB). Dann wird die Bescheinigung vorerst nicht ausgestellt. Eine eigene bekommen Sie dadurch nicht, und ob die blosse Ank\u00fcndigung einer Klage gen\u00fcgt, handhaben die Kantone unterschiedlich. Die Einsprache kostet wenig, ist rasch erledigt und bringt die Gegenseite meist an den Tisch, w\u00e4hrend die eigentliche Klage noch vorbereitet wird.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-9600346\" data-block-id=\"9600346\"><p class=\"stk-block-text__text\">Ein Sicherungsinventar nach Art. 553 ZGB k\u00f6nnen Sie nach der Rechtsprechung auch dann verlangen, wenn Sie noch nicht als Erbe anerkannt sind. Es h\u00e4lt fest, was zum Todeszeitpunkt vorhanden war. Ein \u00f6ffentliches Inventar nach Art. 580 ZGB steht Ihnen dagegen nicht zu, daf\u00fcr braucht es die Erbenstellung (BGE 143 III 369). Wer beides verwechselt, beantragt beim Amt das falsche und erh\u00e4lt einen abschl\u00e4gigen Entscheid, den er bezahlt.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-8dc848d\" data-block-id=\"8dc848d\"><p class=\"stk-block-text__text\">Wo konkrete Anhaltspunkte f\u00fcr Zuwendungen bestehen, ist eine Auskunftsklage m\u00f6glich, h\u00e4ufig als Stufenklage verbunden mit einem noch unbezifferten Zahlungsbegehren (Art. 85 ZPO). Und wenn zu bef\u00fcrchten ist, dass in der Zwischenzeit Werte verschwinden, kommen vorsorgliche Massnahmen in Betracht, etwa eine Anweisung an das Grundbuchamt (Art. 261 f. ZPO). Im ordentlichen G\u00fcterstand der Errungenschaftsbeteiligung steht jedem Ehegatten die H\u00e4lfte dessen zu, was der andere w\u00e4hrend der Ehe erwirtschaftet hat (Art. 215 ZGB). Was der \u00fcberlebende Ehepartner auf diesem Weg bekommt, ist gar nie Nachlass und z\u00e4hlt bei der Pflichtteilsrechnung nicht mit.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-143d161\" data-block-id=\"143d161\"><p class=\"stk-block-text__text\">Durch Ehevertrag l\u00e4sst sich diese Aufteilung verschieben, im Extremfall bis zum vollen Betrag (Art. 216 Abs. 1 ZGB). Und hier steht eine Regel, die viele \u00fcberrascht. Was der \u00fcberlebende Ehepartner \u00fcber seine gesetzliche H\u00e4lfte hinaus erh\u00e4lt, z\u00e4hlt bei den Pflichtteilen der gemeinsamen Kinder nicht mit (Art. 216 Abs. 2 ZGB). F\u00fcr die Kinder ist dieses Geld schlicht weg, und sie k\u00f6nnen nichts dagegen tun. Wehren k\u00f6nnen sich nur Kinder aus einer fr\u00fcheren Beziehung und deren Nachkommen (Art. 216 Abs. 3 ZGB), und f\u00fcr sie ist genau dieser Betrag der erste, der bei den lebzeitigen Zuwendungen zur\u00fcckgeholt wird (Art. 532 Abs. 2 ZGB). Verschieben l\u00e4sst sich dabei nur, was das Paar w\u00e4hrend der Ehe erwirtschaftet hat. Was einer in die Ehe mitgebracht oder selbst geerbt hat, das sogenannte Eigengut, bleibt aussen vor.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-a577d22\" data-block-id=\"a577d22\"><p class=\"stk-block-text__text\">F\u00e4llt der Nachlass \u00fcberraschend klein aus, fragen Sie als Erstes nach zwei Dokumenten. stk-block stk-5301d29\" data-block-id=\"5301d29\"><p class=\"stk-block-text__text\">Viele Ehepaare wollen zuerst den \u00fcberlebenden Partner absichern und die Kinder erst danach zum Zug kommen lassen. Das Gesetz bietet daf\u00fcr ein Instrument, das f\u00fcr die Kinder unangenehm ausfallen kann.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-51e4d45\" data-block-id=\"51e4d45\"><p class=\"stk-block-text__text\">Ein Ehepaar kann im Testament festlegen, dass der \u00dcberlebende den Teil der Erbschaft, der eigentlich den gemeinsamen Kindern geh\u00f6rt, bis zu seinem Tod nutzen darf. Er wohnt also weiter im Haus und beh\u00e4lt Mieten und Zinsen. \u00dcber die andere H\u00e4lfte des Nachlasses darf der Verstorbene zus\u00e4tzlich frei bestimmen, meist zugunsten desselben Ehepartners (Art. 473 ZGB). F\u00fcr die Kinder heisst das, dass sie zwar im Grundbuch stehen, zu Lebzeiten des \u00fcberlebenden Elternteils aber nichts ausbezahlt bekommen. Erst wenn dieser wieder heiratet oder eine eingetragene Partnerschaft begr\u00fcndet, f\u00e4llt die Nutzung an dem Teil weg, der sonst pflichtteilsgesch\u00fctzt w\u00e4re. Seit 2023 ist der frei verf\u00fcgbare Anteil daneben von einem Viertel auf die H\u00e4lfte gestiegen, der Spielraum f\u00fcr Erblasser also gr\u00f6sser geworden.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-739952d\" data-block-id=\"739952d\"><p class=\"stk-block-text__text\">Diese Regel gilt allerdings nur gegen\u00fcber gemeinsamen Nachkommen. Kinder aus einer fr\u00fcheren Beziehung m\u00fcssen sich eine solche Belastung nicht gefallen lassen. Und geht die Verf\u00fcgung \u00fcber den gesetzlichen Rahmen hinaus, ist sie im Mehrbetrag herabsetzbar.<\/p><\/div>\n\n\n\n<h3 id=\"das-vermogen-wurde-zu-lebzeiten-verschenkt\" class=\"wp-block-heading\">Das Verm\u00f6gen wurde zu Lebzeiten verschenkt<\/h3>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-4441a94\" data-block-id=\"4441a94\"><p class=\"stk-block-text__text\">Wurde zu Lebzeiten verschenkt, l\u00e4sst sich ein Teil davon zur\u00fcckholen. Erfasst wird vor allem, was ein Kind schon zu Lebzeiten als Vorschuss auf sein Erbe bekommen hat, was jemand als Abfindung f\u00fcr einen Erbverzicht erhielt, jede Schenkung aus den letzten f\u00fcnf Jahren vor dem Tod und jede Schenkung, die der Verstorbene jederzeit h\u00e4tte zur\u00fcckfordern k\u00f6nnen. Geschenke in \u00fcblicher H\u00f6he bleiben aussen vor. Ohne jede Frist erfasst wird ausserdem, was erkennbar nur weggegeben wurde, um den Pflichtteil auszuh\u00f6hlen (Art. 527 ZGB).<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-f5f0208\" data-block-id=\"f5f0208\"><p class=\"stk-block-text__text\">Achten Sie auf die Zeitrechnung, denn sie funktioniert anders, als viele annehmen. Eine Schenkung verliert mit wachsendem Abstand zum Todestag nicht an Gewicht. Innerhalb der f\u00fcnf Jahre z\u00e4hlt sie voll, danach gar nicht mehr. Und die F\u00fcnfjahresfrist ist ohnehin nur eine von mehreren Varianten, denn frei widerrufbare Zuwendungen und Umgehungsgesch\u00e4fte kennen \u00fcberhaupt keine Frist.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-62d9a76\" data-block-id=\"62d9a76\"><p class=\"stk-block-text__text\">Bei Zuwendungen an Kinder und Enkel kommt ein zweiter Weg hinzu, die Ausgleichung. Was der Erblasser seinen Nachkommen als Heiratsgut, Ausstattung, Verm\u00f6gensabtretung oder Schulderlass zugewendet hat, wird bei der Teilung angerechnet, sofern er nicht ausdr\u00fccklich das Gegenteil verf\u00fcgt hat (Art. 626 Abs. 2 ZGB). Dieser Weg setzt allerdings voraus, dass Sie bereits Erbe sind.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-a394f04\" data-block-id=\"a394f04\"><p class=\"stk-block-text__text\">Zur\u00fcckgeholt wird in einer festen Reihenfolge. Zuerst zahlen die gesetzlichen Erben, dann die im Testament Bedachten, zuletzt die zu Lebzeiten Beschenkten. Und unter den Beschenkten trifft es zuerst den Ehepartner aus dem Ehevertrag, dann die Beg\u00fcnstigten frei widerruflicher Zuwendungen und der S\u00e4ule 3a, dann den Rest, wobei die j\u00fcngste Schenkung vor der \u00e4ltesten drankommt (Art. 532 ZGB).<\/p><\/div>\n\n\n\n<h3 id=\"ein-teil-des-vermogens-liegt-in-der-vorsorge\" class=\"wp-block-heading\">Ein Teil des Verm\u00f6gens liegt in der Vorsorge<\/h3>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-089b59d\" data-block-id=\"089b59d\"><p class=\"stk-block-text__text\">Guthaben der S\u00e4ule 3a gehen nicht in den Nachlass, sondern direkt an die beg\u00fcnstigten Personen. F\u00fcr den Pflichtteil sind sie deswegen nicht unsichtbar. Seit 2023 werden sie ausdr\u00fccklich hinzugerechnet und k\u00f6nnen zur\u00fcckgeholt werden, bei der Versicherungsl\u00f6sung mit dem R\u00fcckkaufswert im Todeszeitpunkt, bei der Bankl\u00f6sung mit dem Anspruch des Beg\u00fcnstigten (Art. 476 und 529 ZGB). Dasselbe gilt f\u00fcr Todesfallversicherungen zugunsten Dritter.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-d01af5b\" data-block-id=\"d01af5b\"><p class=\"stk-block-text__text\">Anders liegt es bei der beruflichen Vorsorge, also der zweiten S\u00e4ule. Ihre Leistungen geh\u00f6ren nicht zum Nachlass und werden von diesen Bestimmungen nicht erfasst.<\/p><\/div>\n\n\n\n<h3 id=\"im-testament-steht-ein-enterbungsgrund\" class=\"wp-block-heading\">Im Testament steht ein Enterbungsgrund<\/h3>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-6fdb733\" data-block-id=\"6fdb733\"><p class=\"stk-block-text__text\">Manche Testamente belassen es nicht beim \u00dcbergehen, sondern entziehen den Pflichtteil ausdr\u00fccklich. Vollst\u00e4ndig entziehen l\u00e4sst er sich nur in zwei F\u00e4llen, n\u00e4mlich bei einer schweren Straftat gegen den Erblasser oder eine ihm nahe verbundene Person und bei schwerer Verletzung familienrechtlicher Pflichten (Art. 477 ZGB). Zerw\u00fcrfnis, Kontaktabbruch oder Entt\u00e4uschung gen\u00fcgen nicht. Daneben gibt es einen engen Sonderfall. Bestehen gegen einen Nachkommen Verlustscheine, also amtliche Bescheinigungen dar\u00fcber, dass Gl\u00e4ubiger bei ihm nichts holen konnten, kann ihm der Erblasser die H\u00e4lfte des Pflichtteils entziehen, wenn er sie dessen Kindern zuwendet. Diese Enterbung f\u00e4llt auf Begehren dahin, wenn die Verlustscheine beim Tod weggefallen sind oder zusammen einen Viertel des Erbteils nicht \u00fcbersteigen (Art. 480 ZGB).<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-35421a8\" data-block-id=\"35421a8\"><p class=\"stk-block-text__text\">Zwei Regeln machen die Enterbung angreifbarer, als sie auf den ersten Blick wirkt. Sie ist nur g\u00fcltig, wenn der Erblasser den Grund in der Verf\u00fcgung selbst angegeben hat. Und wenn der Enterbte sie anficht, muss nicht er die Unrichtigkeit beweisen, sondern derjenige, der aus der Enterbung Vorteile zieht, muss ihre Richtigkeit belegen (Art. 479 ZGB). Gelingt dieser Beweis nicht oder fehlt die Begr\u00fcndung ganz, bleibt die Verf\u00fcgung nur insoweit bestehen, als sie sich mit dem Pflichtteil vertr\u00e4gt. Hatte der Erblasser sich \u00fcber den Enterbungsgrund sogar offensichtlich geirrt, f\u00e4llt sie ganz dahin, und der Enterbte erh\u00e4lt seinen vollen gesetzlichen Erbteil.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-a94f5f2\" data-block-id=\"a94f5f2\"><p class=\"stk-block-text__text\">Wirkt die Enterbung dagegen, ist sie hart. Der Enterbte kann weder an der Erbschaft teilnehmen noch auf Herabsetzung klagen. Seine eigenen Nachkommen behalten ihr Pflichtteilsrecht allerdings so, wie wenn er den Erbfall nicht erlebt h\u00e4tte (Art. 478 ZGB).<\/p><\/div>\n\n\n\n<h3 id=\"wer-erbe-wird-haftet-auch-fur-die-schulden\" class=\"wp-block-heading\">Wer Erbe wird, haftet auch f\u00fcr die Schulden<\/h3>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-3765647\" data-block-id=\"3765647\"><p class=\"stk-block-text__text\">Mit dem erfolgreichen Urteil werden Sie Erbe, und mit der Erbschaft gehen auch die Schulden des Erblassers auf Sie \u00fcber. Das \u00fcberrascht viele, die den Pflichtteil f\u00fcr eine reine Geldforderung gehalten haben. Die Erben haften daf\u00fcr solidarisch, jeder kann also f\u00fcr die ganze Schuld belangt werden, und zwar auch mit seinem pers\u00f6nlichen Verm\u00f6gen (Art. 560 und 603 ZGB).<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-fb3aff9\" data-block-id=\"fb3aff9\"><p class=\"stk-block-text__text\">Das \u00fcbliche Schutzinstrument ist das \u00f6ffentliche Inventar, das die Haftung auf die darin verzeichneten Schulden begrenzt. Es muss binnen eines Monats verlangt werden und setzt die Erbenstellung voraus, die ein \u00dcbergangener zu diesem Zeitpunkt noch nicht hat. Ob die Frist f\u00fcr ihn sp\u00e4ter neu zu laufen beginnt, ist ungekl\u00e4rt. Bei einem werthaltigen Nachlass spielt das keine Rolle. Sind die Verbindlichkeiten unklar, sollten Sie sie kennen, bevor Sie klagen.<\/p><\/div>\n\n\n\n<h2 id=\"vom-testament-bis-zum-geld\" class=\"wp-block-heading\">Vom Testament bis zum Geld<\/h2>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-9a593b5\" data-block-id=\"9a593b5\"><p class=\"stk-block-text__text\">Der Weg beginnt mit der Testamentser\u00f6ffnung. Jede vorgefundene letztwillige Verf\u00fcgung ist der Beh\u00f6rde am letzten Wohnsitz einzuliefern, die sie binnen eines Monats nach der Einlieferung er\u00f6ffnet und den Beteiligten eine Abschrift zustellt (Art. 556 ff. ZGB). Wie diese Beh\u00f6rde heisst, ist kantonal verschieden, je nachdem Teilungsbeh\u00f6rde, Erbschaftsamt, Notariat oder Bezirksgericht. H\u00e4ufig hat der Erblasser zus\u00e4tzlich einen Willensvollstrecker eingesetzt (Art. 517 f. ZGB). Er verwaltet den Nachlass und f\u00fchrt die Teilung durch, vertritt dabei aber den Willen des Erblassers und nicht die Interessen einzelner Beteiligter. Gegen\u00fcber den Erben schuldet er Rechenschaft, und er untersteht einer kantonalen Aufsichtsbeh\u00f6rde, die ihm Weisungen erteilen und ihn im \u00e4ussersten Fall absetzen kann.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-ed7fed3\" data-block-id=\"ed7fed3\"><p class=\"stk-block-text__text\">In den ersten Wochen z\u00e4hlt, dass nichts verschwindet und dass keine Frist anl\u00e4uft, von der Sie nichts wissen. Von dem Tag, an dem Ihnen die Abschrift des Testaments zugestellt wurde, rechnet das Gericht sp\u00e4ter zur\u00fcck. Bewahren Sie den Umschlag mit dem Poststempel auf.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-bb37731\" data-block-id=\"bb37731\"><p class=\"stk-block-text__text\">Viele F\u00e4lle enden danach mit einer Einigung, denn auch die Erben haben selten Interesse an einem Verfahren \u00fcber Jahre. Nur halten Verhandlungen die Jahresfrist nicht an.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-d3b97ab\" data-block-id=\"d3b97ab\"><p class=\"stk-block-text__text\">Bewegt sich nichts, f\u00fchrt der Weg \u00fcber die Schlichtungsbeh\u00f6rde. Ein Schlichtungsversuch ist bei erbrechtlichen Klagen der Regelfall. Ab einem Streitwert von 100&#8217;000 Franken k\u00f6nnen beide Seiten gemeinsam darauf verzichten. Einseitig kann die klagende Partei es unter anderem dann, wenn die beklagte Partei im Ausland wohnt, was allerdings voraussetzt, dass das auf alle Beklagten zutrifft (Art. 199 Abs. 2 ZPO). Zust\u00e4ndig ist das Gericht am letzten Wohnsitz des Erblassers (Art. 28 ZPO).<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-e60364d\" data-block-id=\"e60364d\"><p class=\"stk-block-text__text\">Beim Geld lohnt der genaue Blick auf die Stichtage, weil sie sich unterscheiden. F\u00fcr die Pflichtteile z\u00e4hlt, was am Todestag da war (Art. 474 ZGB). Bei der sp\u00e4teren Teilung werden Grundst\u00fccke dagegen zu dem Verkehrswert angerechnet, den sie im Zeitpunkt der Teilung haben (Art. 617 ZGB). Zieht sich ein Streit \u00fcber Jahre und steigt der Immobilienmarkt, wirkt sich das also unterschiedlich aus. Sind sich die Erben \u00fcber den Wert nicht einig, wird er durch amtlich bestellte Sachverst\u00e4ndige gesch\u00e4tzt (Art. 618 ZGB). Eine Sonderregel gilt f\u00fcr landwirtschaftliche Gewerbe, die dem selbstbewirtschaftenden Erben zum Ertragswert angerechnet werden, der deutlich unter dem Verkehrswert liegt.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-3598730\" data-block-id=\"3598730\"><p class=\"stk-block-text__text\">Steht Ihre Erbenstellung fest und fliesst trotzdem nichts, gibt es weitere Hebel. Blockiert sich die Erbengemeinschaft selbst, kann jeder Miterbe bei der Beh\u00f6rde einen Erbenvertreter verlangen, der f\u00fcr die Gemeinschaft handelt (Art. 602 Abs. 3 ZGB). \u00dcber unstrittige Positionen l\u00e4sst sich vorab teilen, statt auf die Einigung im Ganzen zu warten. Und gegen einen Willensvollstrecker, der nicht abrechnet, steht die Aufsichtsbeschwerde offen.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-a841f0e\" data-block-id=\"a841f0e\"><p class=\"stk-block-text__text\">Die Prozesskosten tr\u00e4gt im Grundsatz die unterliegende Partei, und dazu geh\u00f6rt auch die Parteientsch\u00e4digung, also die Anwaltskosten der Gegenseite (Art. 106 ZPO). Beides bemisst sich nach dem Streitwert und ist kantonal geregelt, sodass die Betr\u00e4ge mit der H\u00f6he des Anspruchs mitwachsen. Bei einem sechsstelligen Streitwert liegen Gerichtsgeb\u00fchr und Parteientsch\u00e4digung zusammen rasch im deutlich f\u00fcnfstelligen Bereich. Seit dem 1. Januar 2025 darf das Gericht im ordentlichen Verfahren h\u00f6chstens die H\u00e4lfte der mutmasslichen Gerichtskosten als Vorschuss verlangen (Art. 98 ZPO). Der Einstieg wird damit billiger, das Risiko im Unterliegensfall bleibt gleich. Die unentgeltliche Rechtspflege, das Schweizer Gegenst\u00fcck zur deutschen Prozesskostenhilfe, deckt bei geringem Einkommen die Gerichtskosten und den eigenen Anwalt, befreit aber ausdr\u00fccklich nicht von der Entsch\u00e4digung an die Gegenpartei (Art. 118 Abs. 3 ZPO). Und Erbrecht ist in Schweizer Rechtsschutzpolicen meist nur ein Zusatzbaustein mit eigener, oft niedriger Deckungssumme, h\u00e4ufig verbunden mit einer Wartefrist und mit dem Todestag als ausl\u00f6sendem Ereignis.
