Two ways to deal with a delayed payout

In most cases, the compulsory share is paid out upon the first request, and that’s the end of the matter.

Things get tricky if no information is provided, if the value of the parental home is set too low, or if the whole process drags on for months. In such cases, we can cover the costs of enforcing the claim or buy the claim from you. In both cases, the cost to you is agreed in advance, and you do not pay anything up front.

  1. Enforce your share

Your law firm will seek payment of the full amount, in court if necessary. The invoices will be sent to us.

  2. Sell your legal share

We will buy your claim at a fixed price. The money will be in your account shortly after the appointment with the solicitor.

The principle behind it

So that your legitimate rights are not thwarted by a lack of funds

Anyone claiming their statutory share in the face of opposition usually has to pay upfront. Advances are due for solicitors’ fees, court costs and expert reports long before the heirs make any payments, and legal expenses insurance rarely covers inheritance cases. As a result, many people give up, even though their claim is well-founded.

That is why Erbfinanz exists. We cover the costs of enforcement and bear the financial risk. Our fee is only deducted from the money you receive.

How a case is handled and how much it costs

  • Stalling is becoming less effective

As we cover the costs, you won’t be put under pressure by rising bills. Many cases are settled without the need for a court ruling.

  • You choose the law firm yourself

The case is being handled by a law firm specialising in inheritance law. If you already have one, we will work with them. Otherwise, we will recommend a suitable one to you.

  • You do not need to negotiate with the heirs

The law firm will handle correspondence, deadlines and negotiations, and, if necessary, will also bring legal proceedings. It will discuss any offers made by the heirs with you.

Further answers on the compulsory share

Who is Erbfinanz intended for?

For close relatives – usually children or spouses – who are entitled to a compulsory share and are unable to make headway with the payment. This applies to people who have been omitted from the will or who are to receive less than they are entitled to. Sometimes the claim arises from gifts made during the testator’s lifetime. Typical situations include those where responses are not forthcoming, valuations are not transparent, or payment is repeatedly postponed.

When is Erbfinanz the right partner?

If you’re unable to make headway on your own. Many compulsory shares are paid out without dispute, in which case you won’t need us. The situation is different if you receive no information, the figures are incorrect or the process drags on for months. We deal with such cases on a daily basis and are familiar with the typical obstacles. In such cases, we can cover the costs of enforcement and the financial risk in return for a pre-agreed share of the proceeds, or we can purchase your claim from you.

Why is a single law firm often not enough?

Without a law firm, you will struggle to make any headway in the face of opposition, but you will bear the financial risk yourself. Fees, court costs and expert reports are due long before the heirs make any payments, and legal expenses insurance policies usually exclude inheritance disputes. We cover these costs and bear the financial risk. Our pre-agreed share is only deducted from the money you actually receive. This means, for example, that the firm can commission an expert report on the actual value of a property without you having to pay for it in advance.

Which of the two paths is right for me?

That depends mainly on how long you can wait and how important a fixed sum is to you. The enforced recovery process aims to recover the full amount and takes time to do so. A sale yields a fixed, albeit lower, sum just a few days after the appointment with the solicitor, and we’ll take care of any further enforcement proceedings. You don’t need to make up your mind before making an enquiry. We’ll explain openly how both options would work in your case, and you can decide.

How much will it cost me?

The enquiry is free of charge, and you won’t have to pay anything up front afterwards either. When it comes to financing, we bear the costs of enforcement, and the previously agreed fee is only deducted from the money you receive. The financial risk therefore lies with us. Upon sale, you will receive a fixed purchase price below the full amount, and we will then bear any further costs. If we are unable to take on a case, we will tell you so openly.

What happens when you make your first enquiry?

You can use the form to describe your situation to us; many of the details can simply be ticked off. You do not need to provide any supporting documents. We examine each case individually and will usually get back to you within a few days. We treat your enquiry confidentially, including with regard to the heirs.

Please give us a brief overview of what this is about

A few basic details about your case will suffice; you do not need to provide exact figures or documents. We will look into your enquiry personally and let you know which of the two options is suitable for you.
